RESOLUTION 99-305
APPROVING FINDINGS OF FACT FOR AMENDING THE TEXT OF CHAPTER 21 OF THE
PLYMOUTH CITY CODE, THE PLYMOUTH ZONING ORDINANCE (99039)
WHEREAS, the City of Plymouth finds it necessary to amend the Zoning Ordinance relating to
temporary outdoor events and sales in the non-residential zoning districts; and
WHEREAS, the Planning Commission has reviewed the text amendments relating to the
regulation of temporary outdoor events and sales at a duly called Public Hearing and recommends
approval; and
WHEREAS, the City Council has adopted Ordinance No. 99-20 amending the Zoning Ordinance
text relating to temporary outdoor events and sales.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that revisions to Sections 21455.11, 21475.13 and 21555.11 of
the City Code are necessary based on the following findings:
1. The amendments are consistent with the Comprehensive Plan and other City policies and
plans. The amendments would encourage orderly development because temporary outdoor
events and sales would be confined to areas with proper access and parking for non-residential
uses.
2. The amendments meet the purpose and intent of the non-residential zoning districts.
Temporary outdoor events and sales are permitted by administrative permit in the non-
residential zoning districts and would be compatible with other uses allowed in the non-
residential zoning districts. The changes to the proposed text in the C-1 zoning district would
apply to all other non-residential zoning districts because all uses permitted by administrative
permit in the C-1 zoning district are permitted in the other non-residential zoning districts.
3. There are no specific infrastructure requirements for temporary outdoor events and sales. The
events would be accessory to a principal use and the ordinance performance standards ensure

that there is adequate access and parking to serve the temporary outdoor events and sales in
the non-residential zoning districts.
4. The ordinance performance standards ensure that temporary outdoor events and sales in the
non-residential zoning districts are operated in a manner that that does not adversely impact
the public health, safety or aesthetics of the community.
