HomeMy WebLinkAboutCity Council Resolution 1999-278CITY OF PLYMOUTH RESOLUTION 99-278 APPROVING A SITE PLAN AMENDMENT AND A CONDITIONAL USE PERMIT AMENDMENT FOR ARMSTRONG; TORSETH, SKOLD AND RYDEEN INC. FOR GREENWOOD ELEMENTARY SCHOOL LOCATED AT 3635 COUNTY ROAD 101 (99032) WHEREAS, Armstrong, Torseth, Skold and Rydeen, Inc. has requested a site plan amendment and conditional use permit amendment to allow an addition to the school and related site improvements at 3635 Co. Rd. 101, legally described as follows: That part of the south '/2 of the northwest of the southeast 1/4, and of the southwest 1/4 of the southeast 1/4, lying southwesterly of the following described line: Commencing at the southeast corner of said southwest 1/4 of the southeast 1/4; thence north along the east line thereof 704 feet to the point of intersection of said east line with the centerline of Medina Road, said point being the point of beginning of the line being described; thence deflecting left 55 degrees 50 minutes along said centerline a distance of 1400 feet; thence on said centerline along a tangential curve to the left having a radius of 700 feet to its intersection with the west line of said south half of the northwest 1/4 of the southeast 1/4, and there ending; except the northeasterly 33 feet of said property; also except that part of said southwest 1/4 of the southeast 1/4 described as follows: Commencing at the southeast corner of said southwest 1/4 of the southeast 1/4; thence north along the east line thereof 290.67 feet to the point of beginning of the exception being described; thence continuing north 413.33 feet to the point of intersection of said east line with the centerline of Medina Road; thence deflecting left 55 degrees 50 minutes along said centerline a distance of 577.6 feet; thence deflecting left 90 degrees a distance of 342 feet; thence deflecting left to the point of beginning; also except that part of said southwest 1/4 of the southeast 1/4 described as follows: Commencing at the southeast corner of said southwest 1/4 of the southeast 1/4; thence north along the east line thereof 704 feet to the point of intersection of said east line with the centerline of Medina Road; thence deflecting left 55 degrees 50 minutes along said centerline a distance of 637.6 feet to the point of beginning of the exceptions being described; thence continuing on last -said course along said centerline 330 feet; thence deflecting left 90 Resolution 99-278 (99032) Page 2 of 4 degrees a distance of 433 feet; thence deflecting left 90 degrees a distance of 330 feet; thence deflecting left to the point of beginning, all in Section 18, Township 118 North, Range 22 West of the 5th Principal Meridian. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Armstrong, Torseth, Skold and Rydeen for a site plan amendment and conditional use permit amendment to allow an addition to the school and related site improvements at 3635 Co. Rd. 101, subject to the following conditions: 1. The site plan amendment and conditional use permit amendment allow construction of a building addition and related site improvements, as shown on plans received by the City on April 5, 1999, except as amended by this resolution. 2. A lighting plan shall be submitted for any new lighting prior to issuance of a building permit. 3. The applicant shall revise the plans to maintain the existing 20 -foot driveway setback along the driveway entrance from Medina Road prior to issuance of a building permit. 4. The conditional use permit standards are met for the building addition and related improvements, as follows: a. The proposed use would comply with the Comprehensive Plan, including the City's policies for wetland protection. b. The proposed use would promote and enhance the general public welfare and would not be detrimental to or endanger the public health, safety, morals or comfort. The building and parking lot expansions would not create a safety hazard on the adjacent public street. c. The building additions would not be injurious to the use and enjoyment of other property in the immediate vicinity, because the proposed improvements would be over 140 feet from the nearest residential property. d. The proposed use would not impede the normal and orderly development and improvement of surrounding property for uses permitted in the RSF-1 zoning district. e. The proposed school building additions would have no effect on public facilities or services. f. The proposed use would comply with the regulations of the RSF-1 zoning district. Resolution 99-278 (99032) Page 3 of 4 g. The proposed school building additions would comply with the performance standards of the Zoning Ordinance. 5. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. e. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
