RESOLUTION 99-256
APPROVING A CONDITIONAL USE PERMIT FOR TRI-STATE DRILLING, INC.
LOCATED AT 16940 STATE HIGHWAY 55 (99037)
WHEREAS, Tri-State Drilling, Inc. has requested a conditional use permit to allow installation of
an eight -foot high screen fence at 16940 State Highway 55, legally described as follows:
The west 552 feet of the southeast 1/4 of the southwest 1/4 lying northeasterly of the northeasterly
right of way line of State Highway No. 55 in Section 17, Township 118, Range 22, Hennepin
County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Tri-
State Drilling, Inc. for a conditional use permit to allow an eight -foot high screen fence at 16940
State Highway 55, subject to the following conditions:
1. The conditional use permit allows installation of an eight -foot high fence, pursuant to the
application and plans received by the City on April 28, 1999, except as amended by this
resolution.
2. The conditional use permit standards are met for an eight -foot high screen fence, as follows:
a. The proposed fence would be consistent with the Comprehensive Plan goals to screen
storage yards from adjacent uses, especially residential areas.
b. The proposed fence would promote and enhance the general public welfare and would not
be detrimental to or endanger the public health, safety, morals or comfort. The fence
would not create a safety hazard to, from or on a public street.

c. The proposed fence would not be injurious to the use and enjoyment of other property in
the immediate vicinity. The fence would not create a safety problem for the adjoining
properties or uses.
d. The proposed fence would not impede the normal and orderly development and
improvement of surrounding properties.
e. The proposed fence would have no effect on public facilities or services.
f. The proposed fence would comply with the regulations of the commercial zoning district,
as well as those of the adjoining RMF -1 district.
g. The proposed fence would comply with the performance standards of the Zoning
Ordinance.
3. The applicant shall obtain a building permit from the Building Division prior to installation of
the fence.
4. The fence shall be fitted with dark green slats.
5. The fence shall be be maintained so as to remain in a good state of repair at all times.
6. Barbed wire is not allowed.
7. A fire lane shall be maintained through the outdoor storage yard at all times.
8. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
9. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof
shall be grounds for revocation.
10. This approval shall expire one year after the date of approval, unless the landowner or
applicant has started the project, or unless the landowner or applicant has received prior
approval from the City to extend the expiration date for up to one additional year, as
regulated under Section 21015.07 of the Zoning Ordinance.
