HomeMy WebLinkAboutCity Council Resolution 1999-247CITY OF PLYMOUTH RESOLUTION 99-247 APPROVING INTERIM USE PERMIT FOR MOEN LEUER CONSTRUCTION FOR PROPERTY LOCATED AT 17430 MEDINA ROAD (9903 5) WHEREAS, Moen Leuer Construction has requested approval of an interim use permit to move approximately 70,000 cubic yards of material from property legally described as: The south 344.3 feet of the southwest quarter of the southwest quarter of Section 17, Township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Moen Leuer Construction for an interim use permit, subject to the following conditions: 1. Approval is for an interim use permit to move approximately 70,000 cubic yards of material according to the plans received by the City on April 29, 1999, except as amended by this resolution. 2. Prior to the issuance of a grading permit, the applicant shall revise the grading plan to indicate the grading limits, and to maintain the tree line along the southern boundary of the site and establish a three -to -one slope in this area. 3. This permit does not include grading of the portion of the site containing the farm buildings. 4. Grading shall not take place within any existing wetland, and mitigation and N URP ponds shall not be constructed, prior to Wetland Conservation Act approvals. 5. Grading activities shall occur only between the hours of 8 a.m. and 7 p.m., Monday through Friday. Resolution 99-247 (99035) Page 2 6. Grading activities shall comply with the City's noise regulations. 7. The applicant shall revegetate the site according to the applicable ordinance standards. 8. The interim use permit will terminate on December 31, 1999. 9. Prior to issuance of a grading permit, the applicant shall provide a written right -of - entry to the Zoning Administrator to enter the land for the purpose of determining compliance with all applicable conditions imposed on the operation. 10. Standard Conditions: a) Compliance with the City Engineer's Memorandum. b) Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. c) Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d) The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation.
