HomeMy WebLinkAboutCity Council Resolution 1999-246CITY OF PLYMOUTH RESOLUTION 99-246 DECLARING FINDING OF "NO NEED" FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) BASED UPON THE REVIEW OF THE ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) DATED MARCH 1999 FOR THE PROJECT PROPOSED BY MOEN LEUER CONSTRUCTION FOR PLYMOUTH PONDS, BUILDINGS 5 THROUGH 8 (99010) WHEREAS, the City Council has reviewed an Environmental Assessment Worksheet (EAW) for a 384,000 square foot office/warehouse/light manufacturing development on May 18, 1999; and, WHEREAS, pursuant to the Minnesota Environmental Review Program rule 4410.4300, Subpart 33, the City of Plymouth, as the responsible government unit submitted an Environmental Assessment Worksheet (EAW) for the proposed project on March 15, 1999; and, WHEREAS, the 30 -day review period expired on April 21, 1999, and all comments and recommendations received from reviewing agents and other interested parties have been considered; and, WHEREAS, it has been determined that the proposed project does not present a potential for environmental impacts of such significance that an Environmental Impact Statement would be required; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does make a Negative Declaration on the need for an Environmental Impact Statement (EIS) for the proposed project known as "Plymouth Ponds, Building 5 through 8" for Moen Leuer Construction, based on the Record of Decision and subject to the following conditions: Compliance with all statements in the attached Record of Decision. Resolution 99-246 Page 2 Strict adherence to the City's Erosion Control Ordinance shall be met during construction and until the site is re -vegetated. Wetland mitigation shall occur as required by the appropriate permitting agencies. The proposed development shall include construction of on-site basins for storm water treatment that meet the National Urban Runoff Program (N URP) water quality guidelines as well as the MPCA's Best Management Practices Manual and City of Plymouth's water quality requirements. Moen Leuer shall sign an agreement with the City for future maintenance of the storm water treatment ponds in accordance with standard City policy. A two -foot minimum vertical separation shall be required between the lowest floor elevation of any building adjacent to wetlands and ponding areas and the 100 -year flood elevation. The development of the site shall comply with the City's shoreland and floodplain overlay zoning district requirements. There shall be no storm water ponds within public rights-of-way.
