HomeMy WebLinkAboutCity Council Resolution 1999-243CITY OF PLYMOUTH RESOLUTION 99-243 APPROVE A CONDITIONAL USE PERMIT AMENDMENT AMENDING RESOLUTION 96-11 FOR CONDITIONAL USE PERMIT, SITE PLAN AND VARIANCE FOR WEST LUTHERAN HIGH SCHOOL FOR PROPERTY LOCATED AT 3350 HARBOR LANE TO REMOVE A CONDITION LIMITING ENROLLMENT TO 150 STUDENTS (99025) WHEREAS, approval of a conditional use permit, site plan and variance for a private high school was requested for property legally described as follows: That part of Lot 3, Block 2, lying north of the south 166.00 feet thereof, and all of Lot 4, Block 2, FOX MEADOWS FIRST ADDITION, according to the recorded plat thereof, Hennepin County, Minnesota together with an easement for ingress and egress, over the north 12 feet of the south 166 feet of Lot 3, Block 2, FOX MEADOWS FIRST ADDITION, Lots 5 and 6, Block 2, FOX MEADOWS FIRST ADDITION, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the City Council approved a conditional use permit, site plan and variance for West Lutheran High School under Resolution 96-11 on January 9, 1996; and WHEREAS, condition no. 2 of Resolution 96-11 stated as follows: "The Conditional Use Permit is for a private high school serving grades 9 through 12 with a maximum enrollment of 150"; and WHEREAS, Blanski Peter Kronlage & Zoch PA has requested that the maximum enrollment limitation be removed from condition no. 2. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does amend the resolution for a conditional use permit, site plan and variance for West Lutheran High Resolution 99-243 Page 2 School by removing the maximum student enrollment limitation from condition no. 2 of Resolution 96-11 as follows: Resolution 96-11 2.
