RESOLUTION NO. 99-238
REQUEST FOR PAYMENT NO. 22 AND FINAL
PEONY LANE
CITY PROJECT NO. 5002
WHEREAS, the City of Plymouth as owner and C. S. McCrossan Construction, Inc., as
contractor, have entered into an agreement for Peony Lane Improvements, City Project
No. 5002, said agreement being dated June 11, 1996; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $3,914,492.75. Six change orders
were approved in the amount of $446,955.88, and the value of the work to
date is $4,347,774.75 and is herewith approved. This project underran the
revised contract amount by $13,673.88 or 0.3%.
2. That the work performed by the contractor for Peony Lane and certified to
the Council by the engineer as acceptable, being the same, is hereby
released from the engineer as acceptable from the contract except as to the
conditions of the performance bond, any and all legal rights of the owner,
required guarantees and correction of faulty work after final payment.
3. Request for Payment No. 22 and Final in the amount of $302,080.87 to C.
S. McCrossan Construction, Inc. for Peony Lane is hereby approved and
the City Finance Director is hereby authorized and directed to pay the
same forthwith.
