RESOLUTION 99-228
AMENDING RESOLUTION 98-234 AND REPEALING RESOLUTION 96-393 RELATING
TO FORSTER PRESERVE PLAT 3, LOCATED NORTHEAST OF OLD ROCKFORD ROAD
AND BALSAM LANE (98051) (96098)
WHEREAS, the City Council approved Resolution 98-234 for a lot consolidation of Lots 1 and
2, Block 1, Forster Preserve Plat 3 on April 15, 1998; and
WHEREAS, the City recently discovered that the legal descriptions provided for Resolution 98-
234 were incorrect; and
WHEREAS, the corrected legal descriptions for the two original properties to be consolidated are
described on Attachment One, attached hereto and hereby made a part hereof, and
WHEREAS, the corrected legal description indicating the approved lot arrangement is described
on Attachment Two, attached hereto and hereby made a part hereof, and
WHEREAS, the City Council approved Resolution 96-393 for a lot division/lot consolidation of
Lots 1 and 2, Block 1, Forster Preserve Plat 3 on July 24, 1996; and
WHEREAS, Resolution 96-393 was never recorded with Hennepin County; and
WHEREAS, Resolution 96-393 is no longer valid or required because the City Council
subsequently approved a lot consolidation under Resolution 98-234, combining the two lots into
one parcel; and
WHEREAS, it would be prudent to repeal Resolution 96-393 in order to eliminate any future
confusion pertaining to the legal description of the subject property.

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does amend Resolution 98-234 and
repeal Resolution 96-393. The legal descriptions for Resolution 98-234 are amended as indicated
on Attachments One and Two of this resolution, subject to the same conditions of approval listed
in Resolution 98-234.
