HomeMy WebLinkAboutCity Council Resolution 1999-219CITY OF PLYMOUTH RESOLUTION 99-219 APPROVING A SITE PLAN AND CONDITIONAL USE PERMIT FOR BEGIN OAKS ENTERPRISES FOR PROPERTY LOCATED SOUTH OF THE CAMELOT RESIDENTIAL NEIGHBORHOODS AND WEST OF I-494 (98184) WHEREAS, Judy Begin of Begin Oaks Enterprises has requested approval of a site plan and conditional use permit to allow development and operation of a nine hole golf course and driving range with related building and parking lot for property legally described as follows: The Northwest Quarter of the Southwest Quarter of Section 3, Township 118, Range 22, Hennepin County, Minnesota. ALSO, The North Half of the Southeast Quarter of the Southwest Quarter of Section 3, Township 118, Range 22, Hennepin County, Minnesota, except the southerly 30 feet of the easterly 700 feet of said North half of the Southeast Quarter of the Southwest Quarter and except that part of said North Half of the Southeast Quarter of the Southwest Quarter which lies easterly of a line running parallel with and distant 237 feet westerly of Line 1 described below: ALSO, The South Half of the Northeast Quarter of the Southwest Quarter of Section 3, Township 118, Range 22, Hennepin County, Minnesota, except that part of said South Half of the Northeast Quarter of the Southwest Quarter which lies easterly of a line running parallel with and distant 237 feet westerly of said Line 1 described below: Line 1. Beginning at a point on the north line of said Section 3, distant 881.8 feet east of the north quarter corner thereof, thence run southwesterly at an angle of 75 degrees 33 minutes 39 seconds from said north section line (measured from west to south) for 2734.93 feet; thence deflect to the left on a 1 degree 00 minute 00 second curve (delta angle 12 degrees 07 minutes 00 seconds) for 1211.67 feet; thence on tangent to said curve for 1000 feet and there terminating. Resolution 99-219 (98184) Page 2 WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Begin Oaks Enterprises for a site plan and conditional use permit to allow development and operation of a nine hole golf course and driving range with related building and parking lot for property located south of the Camelot residential developments and west of I-494, subject to the following conditions: 1. The site plan and conditional use permit allows a nine -hole golf course and driving range with relating building and parking lot, pursuant to the plans received by the City on December 11, 1998, March 1, 1999, and March 18, 1999, except as amended by this resolution. 2. The conditional use permit standards are met for the use, as follows: a. Comprehensive Plan: Golf courses are an allowable use in the FRD (Future Restricted Development) zoning district and would, therefore, be consistent with the Comprehensive Plan. The project would not result in the need for additional public facilities or changes in the City's Capital Improvement Program. b. Public Welfare: Approval of the conditional use permit would not be detrimental to the public health, safety, morals or comfort. The installation of netting and fencing would adequately protect the public. The proposed site plan conforms with the FRD district standards. c. Impact on Surrounding Property: The proposed recreational use would not be injurious to the immediately surrounding properties. The estimated traffic generation would equivalent to roughly 16.5 acres of single family development for this 65 -acre site. d. Orderly Development: With the easement that would be provided for future Fernbrook Lane, the proposed golf course and driving range would not impede improvement of the surrounding properties. e. Public Facilities: The subject site would be served by a private well and septic system. Public utilities abut the site and the club house could be connected to municipal services after the area is brought into the Metropolitan Urban Service Area. The site is adequately served by public streets. Access to the site would be from Yucca Lane. The proposed use would not cause traffic congestion in the public streets. f. District Regulations: The proposed site plan meets the applicable regulations of the FRD zoning district with the exception that the height of the club house which is presently unknown. Prior to issuance of building permits, the applicant must demonstrate compliance with the City's building height requirement. g. Performance Standards: The proposed building, site plan, and use appear to be consistent with most of the performance standards outlined in the Zoning Ordinance and all must be found consistent prior to the issuance of any permits. Resolution 99-219 (98184) Page 3 3. Prior to issuance of any permits, the applicant shall provide an easement for future Fernbrook Lane, as indicated on the March 1, 1999 site plan. Upon final determination of the Fernbrook Lane alignment, the City would vacate any unneeded portion of this easement. 4. Prior to issuance of any permits, the applicant shall provide the City with soil tests for the septic system. 5. Prior to the issuance of any permits, the applicant shall revise the site plan to show 26 -foot drive aisles in the parking lot and 9 -foot by 18.5 -foot parking stalls. 6. No building permit review of the club house building will be conducted until the building permit is applied for. 7. A grading permit is required prior to commencing construction. 8. The lights for the driving range must be turned off no later than 11:00 p.m. 9. The light source for all lighting must be shielded or treated in a manner so as to limit glare onto I-494 or and nearby properties. 10. The club house must be connected to municipal water and public sanitary sewer if and when the private well or septic system fails. 11. Approval of beer sales at the club house will require City approval of a) a Zoning Ordinance text amendment and b) a license for beer sales. 12. Signage for this site shall be in compliance with the Sign Ordinance. 13. The existing green pole building (roughly 50' by 154') and the existing silo may remain on the site. All other buildings must be removed. The green pole building may be used for storage and maintenance of golf carts and other similar equipment related to the golf course use. 14. Prior to operation of the golf course, the applicant must provide a gutter system on the green pole building to direct storm water runoff away from the residential lots to the north. 15. The applicant will work with the City's Park and Recreation Department to establish a trail around the portion of Mud Lake located on the proposed golf course site. Prior to establishment of any trail, the applicant and the City shall enter into an agreement regarding the construction, maintenance, use and liability for the trail. Resolution 99-219 (98184) Page 4 16. Prior to issuance of any permits, the applicant shall obtain the necessary wetland alteration permit. 17. Prior to issuance of any permits, the applicant shall provide the Planning Division with three full sets of plans indicating all revisions to the grading plan and site plan. 18. All drive aisles must be constructed to fire lane standards. 19. When municipal water is provided on the site, the locations of fire hydrants must be approved by the Fire Inspector. 20. The club house building must be sprinkled. 21. Approved address signage is required at the drive entrance from Yucca Lane. 22. An automatic fire detection system is required for the existing green pole building. 23. The applicant will be required to install additional 30 -foot high netting along the seventh hole in the event that the City selects that portion of Alignment B for Fernbrook Lane parallel to this hole, to the extent needed to protect the roadway from intrusion of golf balls. 24. If the club house is connected to municipal services in the future, the City will require payment of the area assessments for sanitary sewer and water at that time for two acres of land. The City will require payment of the area assessments for sanitary sewer and water for the balance of the site at such time as the site develops (or redevelops) for a use other than the golf course/driving range. 25. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Prior to issuance of permits, submission of the required Financial Guarantee and Site Performance Agreement. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. Compliance with the Ordinance regarding the location of fire lanes and fire lane signage. f. The conditional use permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning Ordinance Resolution 99-219 (98184) Page 5 ADOPTED by the City Council on May 4, 1999.
