HomeMy WebLinkAboutCity Council Resolution 1999-218CITY OF PLYMOUTH RESOLUTION 99-218 FINDING THAT THE PROPOSED BEGIN OAKS GOLF COURSE PROJECT SHOULD BE EXEMPT FROM THE INTERIM ORDINANCE TEMPORARLY PROHITBITING ALL ZONING AND SUBDIVISON APPROVALS WITHIN THE 2020 EXPANSION AREA OF NORTHWEST PLYMOUTH (98184) (98207) WHEREAS, on January 5, 1999, the City Council approved an interim ordinance temporarily prohibiting all zoning and subdivision approvals within the 2020 expansion area of Northwest Plymouth; and WHEREAS, the purpose of the interim ordinance is to allow the City the time needed to complete an in-depth study of the area and to complete its update of the Comprehensive Plan; and WHEREAS, the City Council found that it needed to adopt the interim ordinance in order to protect its ability to plan for urban development within the 2020 expansion area, because the current plan and regulations do not provide adequate tools to protect the City's interest in good planning; and WHEREAS, premature development approvals may interfere with orderly planning and development of the area; and WHEREAS, on November 24, 1998, the City received a complete application from Judy Begin, Begin Oaks Enterprises, for a nine hole golf course and driving range with related building and parking lot for property located south of the Camelot residential developments and west of I-494; and WHEREAS, the Begin Oaks Golf Course proposal was complete and received by the City prior to adoption of the interim ordinance; and WHEREAS, the Begin Oaks Golf Course proposal was the only pending development application for property located within the 2020 expansion area of Northwest Plymouth at the time the City adopted the interim ordinance; and WHEREAS, the Begin Oaks golf course proposal is subject to the interim ordinance and may not proceed with site plan and conditional use permit approval until the interim ordinance expires, unless the City Council grants the golf course proposal an exemption from the interim ordinance; and Resolution 99-218 Page 2 WHEREAS, several conditions would be placed on the golf course proposal to ensure that its development and operation would not interfere with the orderly planning and development of the 2020 expansion area of Northwest Plymouth; and WHEREAS, the Planning Commission has reviewed the request and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Begin Oaks Enterprises for an exemption to the interim ordinance, with the following findings of fact: 1. The Begin Oaks Golf Course application would include several conditions of approval to ensure that its development and operation would not interfere with orderly planning and development of the area, therefore, the purpose of the interim ordinance would not be compromised with this exemption. 2. The Begin Oaks Golf Course application was the only complete application received by the City prior to adoption the interim ordinance, therefore granting an exemption would not set a precedent for granting other exemptions. Adopted by the City Council on May 4, 1999.
