HomeMy WebLinkAboutCity Council Resolution 1999-173CITY OF PLYMOUTH RESOLUTION NO. 99-173 RESOLUTION IMPOSING CIVIL PENALTY AGAINST FOUR SEASONS LIQUOR II, INC. FOR A LIQUOR LICENSE VIOLATION WHEREAS, the Plymouth Police Department routinely conducts compliance checks on licensed liquor establishments within the City; and WHEREAS, during one of these checks conducted on October 27, 1998, an individual employed at Four Seasons Liquor 11, Inc., 4232 Lancaster Lane, sold an alcoholic beverage to an underage person; and WHEREAS, that individual has appeared in Hennepin County District Court and been found guilty of this violation; and WHEREAS, Minnesota State Statute and Plymouth City Code allow for administrative civil penalties against the license holders for such violations. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, the City Council imposes a civil penalty against Four Seasons Liquor 11, Inc., suspending their license for five (5) days to be scheduled by the Police Chief, and an administrative fine of Five Hundred and No/100 Dollars ($500.00). Four (4) days of the license suspension are stayed for eighteen (18) months from the date this Resolution is adopted, upon condition of no violation of State law or City ordinance involving sale, consumption or display of alcoholic beverages. If a violation occurs, the stay shall be revoked immediately, if ordered by the City Council after a hearing. The hearing on the revocation of the stay may proceed before final disposition of the criminal case on the new violation. Adopted by the City Council on April 6, 1999.
