RESOLUTION NO. 99-164
ORDERING PUBLIC HEARING ON THE VACATION OF
PART OF A DRAINAGE EASEMENT FOR PONDING
LOT 1, BLOCK 1
MINNEAPOLIS INDUSTRIAL PARK 6TH ADDITION
WHEREAS, pursuant to M.S.A. 412.851 and the City Charter Section 12.06, Chris Kirby of
Carlson Real Estate Company has petitioned the City Council for the vacation of the following
drainage easement for ponding:
That part of the drainage easement for ponding purposes over Lot 1, Block 1,
MINNEAPOLIS INDUSTRIAL PARK 6TH ADDITION, which lies northwest of the
following described line:
Commencing at the most westerly corner of said Lot 1; thence on an assumed
bearing of North 6 degrees 08 minutes 12 seconds East along the westerly
line of said Lot 1 a distance of 44.73 feet; thence North 11 degrees 50
minutes 52 seconds East along the westerly line of said Lot 1 a distance of
96.36 feet; thence North 53 degrees 00 minutes 00 seconds East a distance of
188.01 feet to the beginning of the line to be described; thence North 61
degrees 47 minutes 19 seconds East a distance of 159.94 feet; thence North
31 degrees 56 minutes 34 seconds East a distance of 112.81 feet; thence
North 20 degrees 28 minutes 59 seconds East a distance of 70.82 feet to the
northeast line of said drainage easement.
That drainage easement for ponding purposes is dedicated and delineated on the plat
of MINNEAPOLIS INDUSTRIAL PARK 6TH ADDITION is also described in part
in a ponding and drainage easement filed as Document No. 1255508 and in part in
ponding easement agreement filed as Document No. 2831403, all in favor of the
public and the City of Plymouth. The drainage easement is also described in a
private Ponding Agreement filed as Document No. 2831401.
AND WHEREAS, the City Council has reviewed said request and found the same to be in order;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That it should, and hereby does, establish the date of May 4,
1999 at 7:00 p.m. in the Council Chambers, Plymouth City Center, 3400 Plymouth Boulevard, as
the time and place for the public hearing of said petition and directs the administrative staff to
publish notice of said hearing as provided by law.
