HomeMy WebLinkAboutCity Council Resolution 1999-161RESOLUTION NO. 99-161 REIMBURSING DEVELOPER FOR REQUIRED TRUNK STORM SEWER CONSTRUCTION CONOR MEADOWS PLAT TWO (96150) WHEREAS, the City of Plymouth and Centex Homes, A Nevada General Partnership have entered into a development contract dated June 24, 1998 for the development Conor Meadows Plat Two (96150); and WHEREAS, as part of this development, the developer agreed to construct trunk storm sewer improvements in Conor Meadows Plat Two in order to conform with the City of Plymouth's overall Storm Drainage Plan; and WHEREAS, installation of the required trunk storm sewer during grading operations for the development was more cost effective then installation with the later Schmidt Lake Road Street and Utility Construction Project, City Project No. 7005; and WHEREAS, the developer installed the required trunk storm sewer across Schmidt Lake Road; and WHEREAS, the work has been completed as detailed in the approved plans and specifications; and WHEREAS, the City of Plymouth has previously accepted the utilities, including the trunk storm sewer, for continual maintenance; and WHEREAS, it is the policy of the City of Plymouth to reimburse developers for the cost of unusual storm sewer construction upon completion in accordance with the approved plans and specifications and acceptance for continual maintenance by the City; and WHEREAS, this amounts to $75,825, based on the actual construction costs and including engineering fees. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: that the developer, Centex Homes, A Nevada General Partnership, is to be reimbursed by the City of Plymouth in the amount of $75,825 for the required trunk storm sewer construction based on the alignment and the approved construction plans. BE IT FURTHER RESOLVED that the funds be allocated from the Schmidt Lake Road Project No. 7005 Construction Fund. Adopted by the City Council on April 6, 1999.
