HomeMy WebLinkAboutCity Council Resolution 1999-154CITY OF PLYMOUTH RESOLUTION 99-154 APPROVING LOT DIVISION/LOT CONSOLIDATION FOR THE U.S. WEST COMMUNICATIONS PROPERTY LOCATED AT 13300 15th AVENUE NORTH AND THE AT&T PROPERTY LOCATED AT 13320 15TH AVENUE NORTH (99013) WHEREAS, an application has been filed by U.S. West Communications which requests approval of a lot division and lot consolidation to divide and consolidate two parcels of land located in Plymouth Orchards 2nd Addition, as legally described on Attachment One, attached hereto and hereby made a part hereof, and WHEREAS, the proposed lot arrangement for which the lot division and lot consolidation is sought is as legally described on Attachment Two, attached hereto and hereby made a part hereof, and WHEREAS, the City Council has fully considered the request for the lot division/lot consolidation. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the lot division/lot consolidation for U.S. West Communications subject to the following conditions: 1. This Resolution approves a lot division/lot consolidation for property located at 13300 15th Avenue and 13320 15th Avenue, in accordance with the application and plans received by the City on February 19, 1999, and revisions received on February 22, 1999, and March 24, 1999. 2. No site plan changes have been approved. 3. Submittal of required drainage and utility easement documents as approved by the City Engineer prior to filing of the lot division/lot consolidation. Resolution 99-154 (99013) Page 2 4. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. ADOPTED by the City Council on April 6, 1999. The undersigned, being the duly qualified and appointed City Clerk of the City of Plymouth, Minnesota, certifies that I compared the foregoing resolution adopted at a meeting of the Plymouth City Council on April 6, 1999 with the original thereof on file in my office, and the same is a correct transcription thereof. Together with part of vacated Old County Road No. 6, accruing thereto by reason of the vacation thereof. PARCEL B (13300 15th Avenue) Lot 3, Block 1, Plymouth Orchards 2nd Addition, according to the recorded plat thereof, Hennepin County, Minnesota, except that part of said Lot 3 lying northerly of a line described as commencing at the northeast corner of Lot 2, said Block 1; thence on an assumed bearing of South 0 degrees 36 minutes 37 seconds East along an east line of said Lot 2 a distance of 287.19 feet to the southeast corner of said Lot 2; being the point of beginning of the line to be described; thence North 89 degrees 23 minutes 23 seconds East a distance of 122.28 feet to the east line of said Lot 3 and said line there terminating. Together with part of vacated Old County Road No. 6, accruing thereto by reason of the vacation thereof. That part of Lot 3, Block 1, Plymouth Orchards 2nd Addition, according to the recorded plat thereof, Hennepin County, Minnesota, described as commencing at the northwest corner of said Lot 3, thence on an assumed bearing of South 00 degrees, 36 minutes 37 seconds East along the west line of Lot 3 a distance of 287.19 feet to the point of beginning; thence continuing South 00 degrees 36 minutes 37 seconds East a distance of 48.50 feet; thence South 89 degrees 23 minutes 23 seconds West a distance of 75.00 feet to a point on a west line of Lot 3; thence North 00 degrees 36 minutes 37 seconds West along said west line of Lot 3 a distance of 48.50 feet to a point on a north line of Lot 3; thence North 89 degrees 23 minutes 23 seconds East along said north line a distance of 75.00 feet to the point of beginning. PARCEL B (13300 15th Avenue) Lot 3, Block 1, Plymouth Orchards 2nd Addition, according to the recorded plat thereof, Hennepin County, Minnesota, except that part of said Lot 3, described as commencing at the northwest corner of said Lot 3, thence on an assumed bearing of South 00 degrees 36 minutes 37 seconds East a distance of 287.19 feet along the west line of Lot 3 to Point "A" being the point of beginning; thence continuing South 00 degrees 36 minutes 37 seconds East a distance of 48.50 feet; thence South 89 degrees 23 minutes 23 seconds West a distance of 75.00 feet to a point on a west line of Lot 3; thence North 00 degrees 36 minutes 37 seconds West along said west line of Lot 3 a distance of 48.50 feet to a point on a north line of Lot 3; thence North 89 degrees 23 minutes 23 seconds East along said north line a distance of 75.00 feet to the point of beginning. Also except that part of said Lot 3 lying northerly of a line described as beginning at said Point "A"; thence North 89 degrees 23 minutes 23 seconds East a distance of 122.28 feet to the east line of said Lot 3 and said line there terminating.
