HomeMy WebLinkAboutCity Council Resolution 1999-116CITY OF PLYMOUTH RESOLUTION NO. 99-116 AUTHORIZING THE VACATION OF PART OF PINEVIEW LANE STREET RIGHT-OF-WAY BASS LAKE HIGHLANDS WHEREAS, the City Council by its own motion proposed the vacation of Pineview Lane street right- of-way in Bass Lake Highlands; and WHEREAS, a public hearing with respect to said vacation was scheduled for March 2, 1999 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of March 2, 1999; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on March 2, 1999 to inform any and all interested parties relevant to the vacation of a certain portion of Pineview Lane street right-of-way in Bass Lake Highlands; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following part of Pineview Lane street right-of-way in Bass Lake Highlands be vacated: That part of Pineview Lane as platted in Bass Lake Highlands, according to the recorded plat, Hennepin County, Minnesota, lying southerly of the southwesterly extension of the southeasterly line of Outlot A, in said plat; and northerly of the westerly extension of the southerly line of Lot 24, Block 2, Bass Lake Highlands. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains C:ADoc=cnts and Settingsubaird\Local Settings\Temp\CCR 1999-116_59311\CCR 1999-116.doc Res. 99-116 Page 2 and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
