HomeMy WebLinkAboutCity Council Resolution 1999-046CITY OF PLYMOUTH RESOLUTION NO. 99-46 ORDERING IMPROVEMENT AND PREPARATION OF PLANS AND SPECIFICATIONS KINGSVIEW LANE IMPROVEMENT PROJECT CITY PROJECT NO. 9002 WHEREAS, The City of Plymouth received a petition from 50% of the property owners adjacent to Kingsview Lane between Gleason Lake Drive and Niagara Lane requesting improvements to Kingsview Lane; and WHEREAS, Resolution No. 98-720 of the City Council adopted the 2"a day of December, 1998, set January 20t1' 1999 for a public hearing with respect to the improvement of Kingsview Lane; and WHEREAS, the City Council has changed their regular meeting dates beginning with the first meeting in January 1999, Resolution No. 98-744 of the City Council adopted the 16"' day of December, 1998, changed the public hearing date from January 20t1' 1999 to January 19t1' 1999 for a public hearing with respect to the improvement of Kingsview Lane; and WHEREAS, the proposed project includes upgrading an existing gravel roadway by the constriction of streets by the installation of bituminous pavement, concrete curb and gutter, storm sewer and all necessary appurtenances; and WHEREAS, Resolution No. 98-643 of the City Council adopted the 21" day of October, 1998, accepted the preliminary engineering report which concluded that the proposed project is feasible, necessary and cost effective; and WHEREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held thereon the 19th day of January, 1999, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, ordering this improvement requires a majority vote of the Council since the project has been petitioned for by the benefiting owners; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such improvement is hereby ordered as proposed in the Council resolution adopted October 21, 1998. 2. The Plymouth Engineering Department is designated as engineer for the improvement. They shall prepare plans and specifications for the making of such improvement. Adopted by the City Council on January 19, 1999.
