HomeMy WebLinkAboutCity Council Resolution 1999-032CITY OF PLYMOUTH RESOLUTION 99-32 APPROVING CONDITIONAL USE PERMIT FOR PUDDLE JUMPER'S CHILD CARE CENTER FOR PROPERTY LOCATED AT 1400 COUNTY ROAD 101 (98196) WHEREAS, Melanie Welton has requested approval of a conditional use permit to allow operation of Puddle Jumper's Child Care Center in the existing building on property legally described as follows: Lot 3, Block 1, Oakwood Square, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Melanie Welton for a conditional use permit for property located at 1400 County Road 101, subject to the following conditions: 1. A conditional use permit for Puddle Jumper's Child Care Center is approved, in accordance with the application and plans received by the City on November 10, 1998 and December 1, 1998, except as amended by this resolution. 2. A copy of the State of Minnesota Department of Human Services license for this property shall be submitted to the City. 3. A revised site plan with fence details shall be provided. A six-foot board fence is required on the east, south and west elevations to screen the outdoor play area from the residential uses. A chain link fence may be provided on the northeast (front) elevation, in lieu of the six-foot board screening fence. 4. A painted crosswalk and a "Caution Children Crossing" sign shall be installed on site to clearly delineate the pedestrian crossing between the day care facility and the play area. Resolution 99-32 (98196) Page 2 5. Six parking stalls near the main entrance must be designated as spaces for drop-off and pick- up of children for the day care facility. A revised site plan, which identifies the designated stalls and provides a sign detail, must be submitted to City staff for review and approval. 6. No trees shall be removed from the site; however, the trees may be trimmed up and the shrubs within the fenced play area may be removed. 7. Building permits are required for all interior or exterior modifications. A registered architect must sign building plans. 8. Prior to occupancy, the applicant must verify compliance with regulations regarding handicapped parking spaces and access. 9. The building code requires one-hour separation walls between the adjoining uses. The applicant must verify compliance or apply for building permits for necessary changes. 10. Prior to occupancy, the applicant must provide allowable area calculations to the building department. 11. Any signage shall comply with the sign regulations of the Zoning Ordinance. 12. Standard Conditions: a. Submission of the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. c. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. d. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
