RESOLUTION NO. 99-20
AUTHORIZING THE MAYOR AND MANAGER TO SIGN AN
ENCROACHMENT AGREEMENT FOR A REATAINING WALL
CONSTRUCTED IN THE
FORESTVIEW LANE RIGHT-OF-WAY AND DRAINAGE AND UTILITY
EASEMENTS WITHIN
PIKE LAKE WOODS 2ND AND 3RD ADDITIONS (98170)
WHEREAS, Tom Belting of Pike Lake Woods Inc., has requested approval to execute an
encroachment agreement for a retaining wall constricted partially in the right of way of
Forestview Lane and drainage and utility easements within Pike Lake Woods 2"a and 3rd
Additions; and
WHEREAS, the property is legally described as:
Lots 2 through 5, Block 2, Pike Lake Woods Addition and
Lot 1, Block 1, Pike Lake Woods -1 Addition; and
WHEREAS, the City finds the Encroachment Agreement to be in the best interest of the
homeowners, subject to the conditions stated therein;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the Mayor and City Manager are hereby
authorized to sign, on behalf of the City of Plymouth, an Encroachment Agreement that
allows a retaining wall to remain in the right-of-way and in the drainage and utility easments
of Forestview Lane within Pike Lake Woods 2"a and -1 Additions.
Adopted by the City Council on January 5, 1999.
