HomeMy WebLinkAboutCity Council Resolution 1999-004CITY OF PLYMOUTH RESOLUTION 99-4 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR OPUS NORTHWEST, LLC FOR PROPERTY LOCATED SOUTH OF 27TH AVENUE BETWEEN FERNBROOK LANE AND NIAGARA LANE (98190) WHEREAS, Opus Northwest, LLC has requested approval of a site plan to allow constriction of a 56,925 -square foot building on property legally described as follows: The west 384.32 feet of Lot 1, Block 1, Scoville Business Park -1 Addition. WHEREAS, Opus Northwest, LLC has requested approval of a conditional use permit to allow up to 100 percent office use within the proposed building, which is located on property zoned I-2 (General Industrial); and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval of the site plan and conditional use permit. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Opus Northwest, LLC for a site plan and conditional use permit for property located south of 27"' Avenue North at 28"' Avenue North, subject to the following conditions: 1. A site plan is approved to allow constriction of a 56,925 -square foot office building on the subject site, in accordance with the plans received by the City on October 30, 1998, except as amended by this resolution. 2. A conditional use permit is approved to allow up to 100 percent office use within the building, with the finding that the request meets the applicable conditional use permit standards. Prior to issuance of building permits, payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of building permit issuance. 4. Any signage shall comply with the sign regulations of the Zoning Ordinance. 5. Prior to issuance of building permits, a detail for any proposed retaining walls shall be provided. 6. The developer shall not use the trail easement along the southern border of the site for access or storage during constriction. Any damage to the trail shall be repaired at the developer's expense. 7. Prior to issuance of building permits, the applicant shall submit a revised lighting plan that indicates compliance with the maximum 0.5 -foot candle standard at the centerline of 27t11 Avenue and at the lot lines of abutting properties. 8. Prior to issuance of building permits, the applicant shall submit a revised landscape plan which shows the width of the two landscape islands (located south of the building) increased by 4 '/z feet each. 9. Prior to issuance of building permits, the applicant shall submit a revised plan that 1) shows locations of fire lanes, and 2) complies with the minimum turning radii, as approved by the Fire Inspector. 10. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. F. Prior to issuance of building permits, submission and approval of fire flow calculations. G. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. Resolution 99-4 (98190) Page 3 H. Compliance with regulations regarding handicapped parking spaces and access. L This approval shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21015.07 of the Zoning Ordinance.
