HomeMy WebLinkAboutCity Council Resolution 1998-753CITY OF PLYMOUTH RESOLUTION 98-753 APPROVING A PUD GENERAL PLAN FOR THE ASSOCIATION FREE LUTHERAN BIBLE SCHOOL FOR PROPERTY LOCATED AT 3110 EAST MEDICINE LAKE BOULEVARD (98163) WHEREAS, The Association Free Lutheran Bible School has requested approval of a PUD General Plan for property presently legally described as follows: TRACT A: That part of Tract C lying South of the South line of Tract B extended West to Medicine Lake, Registered Land Survey No. 606, Files of Registrar of Title, County of Hennepin. (Torrens Certificate No. 512199) That part of Lot 22, "Auditor's Subdivision Number 333 Hennepin County, Minnesota" lying East of a line drawn South at a right angle from the North line of said Lot from a point therein 4091.62 feet West, measured along the East and West quarter line of Section 24 in Township 118, Range 22 from the East Quarter corner thereof, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County. (Torrens Certificate No. 512199) Lots 21 and 23, Auditor's Subdivision No. 333, Hennepin County, Minnesota. That part of the following described property line east of the West right-of-way of East Medicine Lake Boulevard to wit: That part of Government Lots 1 and 2 in Section 24 in Township 118, Range 22 described as follows: Beginning at a point in the East and West Quarterline of said Section 24, 136.28 rods West of the Southeast corner of the Northeast Quarter of said Section 24; thence continuing West along said East and West Quarterline 1843 feet to the actual point of beginning of the tract to be described; thence North at right angles with said Quarterline, 50 feet; thence West parallel with Resolution 98-753 (98163) Page 2 said Quarterline 302 feet, more or less, to the Easterly Shoreline of Medicine Lake; thence Southeasterly along said shoreline 82.5 feet, more or less, to its intersection with the Southerly line of the Northerly 15 feet of said Government Lot 2; thence Easterly along said Southerly line 249.9 feet, more or less, to a point in a line drawn South from the actual point of beginning and at right angles with said East and West Quarterline; thence North along said line as drawn, 15 feet to the actual point of beginning, according to the United States Government Survey thereof. (Torrens Certificate No. 510702) WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by The Association Free Lutheran Bible School for a PUD General Plan for the roughly 23 -acre site located at 3110 East Medicine Lake Boulevard, subject to the following conditions: 1. Approval of the PUD General Plan is contingent on the adoption of the associated Land Use Guide Plan Amendment and PUD Rezoning. 2. A PUD General Plan is approved to allow expansion of the bible school and seminary use on the site, in accordance with the plans received by the City on September 24, 1998, except as amended by this resolution. 3. The permitted uses in the PUD shall include administrative office use on Lot 1, bible school and seminary use for post high school students (including related housing) and church use (until the lease with Medicine Lake Lutheran Church expires) on Lot 2, together with accessory uses related to the above-mentioned uses. 4. Development standards are as indicated on the PUD General Plan. 5. The PUD General plan for this site includes all existing strictures except the cabin located in the southwest portion of the site, together with: a) a new two-story student center containing roughly 42,400 square feet (including bible school administration offices, eight classrooms, staff offices, a library, a cafeteria, and the student center); b) a new single/two-story multi-purpose gymnasium/music building containing roughly 30,100 square feet (including a 1,000 seat gymnasium with floor seating, stage, racquetball court, weight room, locker rooms, music ministry staff offices, practice rooms, and a music library); Resolution 98-753 (98163) Page 3 c) four new two-story dormitory buildings containing roughly 8,125 square feet each, plus a roughly 3,050 square foot commons area to connect the four buildings into two sets of two; and d) four new two-story married student housing buildings containing four units each, with roughly 1,426 square feet per unit (including single car garage). e) A new roughly 26 -foot by 95 -foot (2,470 square foot) addition onto the existing maintenance garage, located in the northwest portion of the site. 6. The facility shall have a maximum enrollment of 375 students and seminarians. 7. The Bible School shall not conduct year-round classes. 8. The church use within the existing seminary/chapel building on Lot 2 shall cease at such time as the lease expires for the Medicine Lake Lutheran Church to occupy the premises. 9. The existing driveway providing direct access to Union Terrace Lane shall be chained off, and used only for emergency vehicles. 10. The building materials and design shall be consistent with the materials and design described in the Appendix to the Petitioner's Narrative dated September 4, 1998. The building materials and architectural design must be reviewed and approved by planning staff with the PUD Final Plan approval. 11. If architectural precast concrete panels are used for the exterior of the gymnasium stricture, the precast panels shall be colored, detailed and patterned to blend with the other campus buildings. 12. The ball field shall not be lighted. 13. Compliance with the Tree Preservation Plan. 14. Any fertilizers used on the site shall be phosphorus -free. 15. The evergreen trees indicated on the landscape plan shall be installed at a height of eight feet rather than six feet. 16. Cross easements for access, driveways, and utilities between Lots 1 and 2 shall be submitted for staff review and shall be filed with Hennepin County at the time of filing the final plat. 17. The developer must obtain and comply with all necessary permits of Bassett Creek, and shall secure the required NPDES permit. Resolution 98-753 (98163) Page 4 18. The impervious surface coverage within the shoreland district is modified to 34 percent. 19. Prior to the issuance of any building permits, the applicant shall develop a Traffic Management Plan as approved by the City Engineer. The Traffic Management Plan shall address events such as graduations and concerts. The Traffic Management Plan may include, but not be limited to, the hiring an off-duty patrol officer to regulate traffic into and out of the site for such events. 20. This resolution approves a variance to the fire code requirement for a fire lane within 50 feet of all sides of the building, pursuant to the PUD General Plan. 21. Standard Conditions: A. Compliance with the City Engineer's Memorandums. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements prior to issuance of any building permits. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valves, fire department connections, and fire lane signage. F. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. H. Compliance with regulations regarding handicapped parking spaces and access. ADOPTED by the City Council this 16th day of December, 1998.
