AND ROTTLUND HOMES FOR "CORNERSTONE COMMONS I ST ADDITION" FOR PROPERTY LOCATED NORTH OF MEDINA ROAD, SOUTH OF HIGHWAY 55, AND EAST OF CO. RD. 101 (98094-F) WHEREAS, Elim Care, Inc. and Rottlund Homes have requested approval of a final plat for Cornerstone Commons I st Addition, containing 129 lots and four outlots for property legally described as follows: PARCEL A The West Half of the South Half of the Northeast Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, Hennepin County, Minnesota. Subject to roads and easements of record if any. Except The north 380 feet of the east 320 feet of the Southwest Quarter of the Northeast Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, Hennepin County, Minnesota. and also excepting That part of the north 50 feet of the Southwest Quarter of the Northeast Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, Hennepin County, Minnesota, lying west of the east 320 feet of said Southwest Quarter of Northeast Quarter of Southeast Quarter. That part of the South Half of the Northwest Quarter of the Southwest Quarter together with that part of the Southwest Quarter of the Southwest Quarter all in Section 17, Township 118, Range 22, Hennepin County, Minnesota, which lies southwesterly of the southwesterly right-of-way line of State Highway No. 55 and which lies northerly of a line described as commencing at the northwest corner of said Southwest Quarter of the Southwest Quarter; thence on an assumed bearing of South 0 degrees 26 minutes 16 seconds East along the west line thereof 739.13 feet to the point of beginning of the line to be described; thence North 53 degrees 29 minutes 37 seconds East 724.56 feet; thence North 87 degrees 35 minutes 15 seconds East 371.03 feet; thence North 44 degrees 55 minutes 13 seconds East 207.85 feet to said southwesterly right-of-way said line there terminating. Parcel C That part of the North Half of the Northeast Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, Hennepin County, Minnesota, which lies southwesterly of the Southwesterly right-of-way line of State Highway No. 55 and which lies easterly of a line described as beginning at the southeast corner of the west 723.6 feet of said North Half of the Northeast Quarter of the Southeast Quarter; thence on an assumed bearing of North 0 degrees 41 minutes 56 seconds West along the east line of said west 723.6 feet, a distance of 397.51 feet to the northeast corner of the south 397.5 feet of said west 723.6 feet of the North Half of the Resolution 98-747 (98094-F) Page 4 Northeast Quarter of the Southeast Quarter; thence North 43 degrees 34 minutes 28 seconds East 320.75 feet to said Southwesterly right-of-way line and said line there terminating. Parcel D That part of the South Half of the Northwest Quarter of the Southwest Quarter and the Southwest Quarter of the Southwest Quarter of Section 17, Township 118, Range 22, Hennepin County, Minnesota, lying Northeasterly of a line drawn parallel with and 150 feet Northeasterly, measured at right angles, from a line described as follows: Commencing at the Northwest corner of said Southwest Quarter of Section 17; thence south along the West line of said Southwest Quarter, a distance of 284.6 feet to the point of beginning of the line being described; thence deflecting left 45 degrees 59 minutes, a distance of 2000 feet, and there ending. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Elim Care and Rottlund Homes for a final plat, subject to the following conditions: 1. This final plat approves 129 lots and four outlots, in accordance with the plans received by the City on August 21, 1998, except as amended by this Resolution. 2. A lighting plan in compliance with Zoning Ordinance requirements shall be submitted for staff review at the time of final plan review. 3. The developer is not responsible to provide utilities or access to the adjacent residential parcel located east of the Church property (PIN# 17-118-22-32-0001). Providing access to this parcel through the subject property would result in additional wetland impacts. This 0.72 acre parcel is under separate ownership and has severe limitations for development because of the setback requirements from the wetlands and Highway 55. Furthermore, the property currently has a field access from Highway 55. 4. The private driveways shall incorporate different paving materials at the entrances to demarcate the private driveways. 5. Wetland buffer monuments shall be located adjacent to all wetlands in accordance with Section 21670.07 of the Plymouth Zoning Ordinance. 6. The extraordinary measures consist of the following: 1) extra erosion control measures during constriction and until the site is re -vegetated, 2) wetland vegetation and natural plantings in the buffer area per city specifications, 3) the use of phosphorus free fertilizer throughout the life of the project, and 4) directing all run-off from buildings, parking lots, and other Resolution 98-747 (98094-F) Page 5 impervious surface into the water quality pond. A detailed plan meeting the above requirements shall be submitted with the PUD final plan. 7. The applicant shall develop a lawn management plan that includes the use of phosphorous free fertilizer to reduce potential negative impacts on the wetlands. 8. If an alternative access to Medina Road is developed for the industrial parcel (Outlot D) access to that parcel from Lawndale Lane shall be prohibited. 9. Standard Conditions: a) Compliance with the City Engineer's Memorandum. b) Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. c) Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. d) Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e) Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. f) An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. g) The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. h) Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of recording the final plat. i) Compliance with regulations regarding handicapped parking spaces and access.
