HomeMy WebLinkAboutCity Council Resolution 1998-731CITY OF PLYMOUTH RESOLUTION 98-731 APPROVING SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT AMENDMENT AND INTERIM USE PERMIT FOR CARLSON REAL ESTATE COMPANY FOR PROPERTY LOCATED AT THE SOUTHWEST QUADRANT OF CARLSON PARKWAY AND I-494 (98179) WHEREAS, Carlson Real Estate Company has requested approval of a site plan amendment and conditional use permit amendment to allow demolition of the Country Kitchen and constriction of a 62 -unit addition to the Country Inns & Suites and an interim use permit for joint parking for property legally described as follows: PARCEL 1 That part of Lot 1, Block 1, Carlson Center 15"' Addition lying south of the following described line: Commencing at the southeast corner of said Lot 1; thence north 1 degree 27 minutes 59 seconds east along the east line of said Lot a distance of 342.65 feet; thence north 5 degrees 30 minutes 16 seconds west along the east line of said Lot a distance of 92.74 feet to the beginning of the line to be described; thence south 81 degrees 09 minutes 35 seconds west a distance of 2 13. 19 feet; thence north 27 degrees 52 minutes 34 seconds west a distance of 71.53 feet to a point on the northeasterly line of said Lot and said line there terminating. PARCEL 2 Lots 2 and 3, Block 1, Carlson Center 12"' Addition. That part of Lot 1, Block 1, Carlson Center 15"' Addition lying north of the following described line: Commencing at the southeast corner of said Lot 1; thence north 1 degree 27 minutes 59 seconds east along the east line of said Lot a distance of 342.65 feet; thence north 5 degrees 30 minutes 16 seconds west along the east line of said Lot a distance of 92.74 feet to the beginning of the line to be described; thence south 81 degrees 09 minutes 35 seconds west a distance of 2 13. 19 feet; thence north 27 degrees 52 minutes 34 seconds west a distance of 71.53 feet to a point on the northeasterly line of said Lot and said line there terminating. Resolution 98-731 (98179) Page 2 WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Carlson Real Estate Company for a site plan amendment, conditional use permit amendment and interim use permit for property located at the southwest quadrant of Carlson Parkway and I-494, subject to the following conditions: 1. The site plan amendment and conditional use permit amendment allow the constriction of a 62 -unit addition to the Country Inns & Suites, in accordance with the plans received by the City on October 2, 1998 and November 3, 1998, except as amended by this resolution. 2. The interim use permit allows shared parking between the subject property and the Two Carlson Parkway office building, in accordance with the plans received by the City on October 2, 1998 and November 3, 1998, except as amended by this resolution. a. The interim use permit is to allow joint use of up to 26 required parking stalls between Country Inns & Suites, Italianni's restaurant and Two Carlson Parkway office building. b. Covenants regarding cross access and fire access shall be submitted for staff review and approval and shall be filed with Hennepin County prior to issuance of building permits. c. The interim use permit shall terminate if any of the following events occur: (1) The use of any of the buildings changes to a use that increases the need for parking spaces. (2) City staff documents a parking problem associated with inadequate parking. (3) The floor area of the building is increased in size. 3. Covenants regarding cross access and parking shall be submitted for staff review and shall be filed with Hennepin County prior to issuance of building permits. 4. The trash enclosure addition shall be constricted of rock -face block to match the existing enclosure. 5. The site plan shall be revised to comply with trash enclosure setback requirements identified in Section 21120.07 of the Zoning Ordinance. 6. All trash and recycling containers and materials shall be stored within the trash enclosure. No outside storage is permitted. 7. The landscaping plan shall be revised to locate all 39 new and transplanted trees on the hotel property. Resolution 98-731 (98179) Page 3 8. All rooftop mechanical equipment shall be screened or painted to match the building. 9. Any signage shall comply with the sign regulations of the Zoning Ordinance. 10. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Submission of the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. e. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage prior to issuance of building permits. f. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. g. Compliance with regulations regarding handicapped parking spaces and access. h. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 and Section 21045.09 of the Zoning Ordinance.
