RESOLUTION NO. 98 - 709
REQUEST FOR PAYMENT NO. 3 AND FINAL
FOUR SEASONS MALL PARK AND RIDE LOT RECONSTRUCTION
CITY PROJECT NO. 7013
WHEREAS, the City of Plymouth as owner and Midwest Asphalt Corporation, as
contractor, have entered into an agreement for the reconstruction of the Four Seasons
Mall Park and Ride Lot, City Project No. 7013, said agreement being dated May 8, 1997;
and
WHEREAS, the City's design consultant has certified his acceptance of the work and his
approval of the final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $89,483.35. One change order was
approved in the amount of $9,069.50 and the value of the work to date is
$98,992.85 and is herewith approved. The final project cost exceeds the
contract amount by $440.00 or 0.45%.
2. That the work performed by the contractor for the reconstruction of the
Four Seasons Mall Park and Ride Lot and certified to the Council by the
design consultant as acceptable, being the same, is hereby released from
the consultant as acceptable from the contract except as to the conditions
of the performance bond, any and all legal rights of the owner, required
guarantees and correction of faulty work after final payment.
3. Request for Payment No. 3 and Final in the amount of $5,367.64 to
Midwest Asphalt Corporation for the Four Seasons Mall Park and Ride
Lot Reconstruction Project No. 7013 is hereby approved and the City
Finance Director is hereby authorized and directed to pay the same
forthwith.
