RESOLUTION 98-695
APPROVING A SITE PLAN AMENDMENT AND CONDITIONAL USE PERMITS FOR
HOLIDAY STATION STORES LOCATED AT 10100 ROCKFORD ROAD (98166)
WHEREAS, Holiday Station Stores has requested a site plan amendment and conditional use
permits to allow a car wash, side yard reduction, and related site improvements at 10100
Rockford Road, legally described as follows:
Lot 2, Block 1, Rockford Square
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Holiday
Station Stores for a site plan amendment and conditional use permits to allow a car wash, side
yard reduction, and related site improvements at 10100 Rockford Road, subject to the following
conditions:
1. The site plan amendment and conditional use permits allow constriction of a car wash, side
yard reduction, and related site improvements, as shown on plans received by the City on
September 11, 1998, except as amended by this resolution.
2. The conditional use permit standards are met for the car wash and reduced side yard, as
follows:
a. The proposed use would comply with the Comprehensive Plan, including the City's
policies for wetland protection.
b. The proposed use would promote and enhance the general public welfare and would not
be detrimental to or endanger the public health, safety, morals or comfort. The car wash
and yard reduction would not create a safety hazard on the adjacent public street.

c. The car wash and yard reduction would not be injurious to the use and enjoyment of other
property in the immediate vicinity, because the neighboring properties consist of
commercial uses of the same intensity.
d. The proposed use would not impede the normal and orderly development and
improvement of surrounding property for uses permitted in the C-3 zoning district.
e. The proposed car wash and yard reduction would have no effect on public facilities or
services.
f. The proposed use would comply with the regulations of the C-3 zoning district.
g. The proposed car wash and yard reduction would comply with the performance standards
of the Zoning Ordinance.
3. Signage for this site shall be in compliance with the Sign Ordinance in effect at the time of sign
permit application.
4. Provide a fire lane section on plans.
5. Prior to issuance of building permits, the applicant shall submit a revised site plan increasing
the parking setback to 11 feet along the east property line.
6. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Submission of the required Financial Guarantee and Site Performance Agreement for
completion of site improvements within twelve months of the date of this Resolution.
c. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
d. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire
lane signage.
e. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
f. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started constriction of the project, or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
