HomeMy WebLinkAboutCity Council Resolution 1998-690CITY OF PLYMOUTH RESOLUTION 98-690 APPROVING PRELIMINARY PLAT FOR THEODORE FLESNER FOR PROPERTY LOCATED AT 16220 OLD ROCKFORD ROAD (98162) WHEREAS, Theodore Flesner has requested approval of a preliminary plat for property legally described as follows: That part of the east '/z of the northeast '/4 section 17-118-22 bounded by a line beginning at the northwest corner of the southeast '/4 of the northeast '/4 of Section 17; thence north along the west line of said east '/z of the northeast'/4 264 feet; thence east at right angles 330 feet; thence south at right angles 446.8 feet more or less to the center line of State Highway No. 55 (so called); thence northwesterly along the center line of said Highway No. 55 369.65 feet more or less to the west line of the east '/z of the northeast '/4 of said Section 17; thence north 16.6 feet more or less to the point of beginning containing about 2.75 acres and excepting therefrom that part taken for road purposes, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Theodore Flesner for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to create two lots, in accordance with the preliminary plat and plans received by the City on August 28, 1998, and revisions received on September 8, 1998 and October 5, 1998, except as amended by this resolution. 2. The plat is subject to the RSF-2 district standards. 3. Lot I and Lot 2 shall share an access at the common lot line. The shared driveway agreements must be approved by City staff and recorded at Hennepin County prior to recording the final plat. Resolution 98-690 (98162) Page 2 4. This plat is subject to all Wetland Ordinance standards. 5. The plan should be revised to show the required 50 -foot average (60 -foot maximum/40-foot minimum) buffer and 15 -foot stricture setback on both lots. 6. Wetland buffer monuments must be installed prior to final grading inspection. 7. The wording "and drainage easement for ponding" shall be added to the plat at the 100 year high water elevation (968.0). 8. A permit from the Metropolitan Waste Control Commission (MWCC) is required prior to connecting to the sanitary sewer in Old Rockford Road. 9. The permit for connecting to the MWCC sanitary sewer must be picked up from the City Engineer. The MWCC requires that they inspect the connection to the sewer, therefore, the MWCC must be contacted and arrangements must be made for inspection. The sewer service may need to be re -excavated for inspection. The cost is the responsibility of the property owner. 10. The plans should be revised to provide a 30 -foot driveway radius at Old Rockford Road. 11. The plat is subject to all Floodplain Overlay District standards, except as amended by this resolution. 12. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. d. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements. e. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. f. Park dedication fees shall be cash fees -in -lieu of land dedication in accordance with the dedication policy in effect at the time the final plat is recorded. This fee shall be paid prior to release of the final plat mylars. g. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. h. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. i. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred Resolution 98-690 (98162) Page 3 resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
