HomeMy WebLinkAboutCity Council Resolution 1998-689CITY OF PLYMOUTH RESOLUTION 98-689 APPROVING CONDITIONAL USE PERMIT FOR THEODORE FLESNER FOR PROPERTY LOCATED AT 16220 OLD ROCKFORD ROAD (98162) WHEREAS, Theodore Flesner has requested approval of a conditional use permit for property legally described as follows: That part of the east '/z of the northeast '/4 section 17-118-22 bounded by a line beginning at the northwest corner of the southeast '/4 of the northeast '/4 of Section 17; thence north along the west line of said east '/z of the northeast'/4 264 feet; thence east at right angles 330 feet; thence south at right angles 446.8 feet more or less to the center line of State Highway No. 55 (so called); thence northwesterly along the center line of said Highway No. 55 369.65 feet more or less to the west line of the east '/z of the northeast '/4 of said Section 17; thence north 16.6 feet more or less to the point of beginning containing about 2.75 acres and excepting therefrom that part taken for road purposes, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Theodore Flesner for a conditional use permit, subject to the following conditions: A conditional use permit is approved to fill a portion of the floodplain, in accordance with the preliminary plat and plans received by the City on August 28, 1998, and revisions received on September 8, 1998 and October 5, 1998, except as amended by this resolution. 2. A conditional use permit is approved for the proposed flood fringe impacts based on the finding that flood storage would increase on the property by filling 27 cubic yards of floodplain and excavating 29 cubic yards of floodplain. Resolution 98-689 (98162) Page 2 3. The mitigation for the filling must be completed as shown on the grading plan. 4. The floodplain fill and excavation must be completed prior to issuance of a building permit. 5. The property is subject to all Floodplain Overlay District standards, except as amended by this resolution. 6. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. b. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
