RESOLUTION 98-687
APPROVING PUD GENERAL PLAN AMENDMENT FOR CALIBER DEVELOPMENT
CORPORATION FOR PROPERTY LOCATED AT THE NORTHWEST QUADRANT OF
POLARIS LANE NORTH AND 25TH AVENUE NORTH (98146)
WHEREAS, Caliber Development Corporation has requested approval of a PUD general plan
amendment for property legally described as follows:
Outlot A, Parkers Lake Corporate Center 8"' Addition, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Caliber
Development Corporation for a PUD general plan amendment, subject to the following
conditions:
1. A PUD general plan amendment for the constriction of a 22,600 -square foot
office/showroom building is approved, according to the plans and application received by the
City on August 6, 1998 and revisions received on September 15, 1998, and October 9, 1998,
except as amended by this resolution.
2. No building permits shall be issued until the final plat is filed and recorded with Hennepin
County.
3. No building permits shall be issued until the PUD final plan is approved by City staff.
4. Loading dock activity shall be prohibited between the hours of 7:00 p.m. and 7:00 a.m.

5. The property owner must comply with Section 21105.06 of the Zoning Ordinance regarding
lighting and glare. If glare becomes a problem, the light fixtures shall be fitted with hoods or
shields to direct the light away from the adjacent homes.
6. The north building elevation shall be finished with eight -inch, rock -face block to match the
color of the brick on the other three elevations. The contrasting band of rock -face block
shown on the top portion of the south, east and west elevations shall be wrapped around the
entire building. The doors in the loading area shall be colored to match the brick -colored
rock -face block on the north elevation.
7. The uses allowed in this PUD are any permitted, accessory, conditional or interim uses
allowed I-1 (Light Industrial) zoning district, provided the office use does not exceed 80
percent of the gross square footage of the building.
8. Development standards shall be as specified in the I-1 zoning district, except that the front
building setback shall be 40 feet, the front parking setback shall be 40 feet, the north parking
setback shall be 13.5 feet and the south parking setback shall be 5 feet, as shown on the plans
on file in the Office of the Zoning Administrator, under file 98146.
9. Prior to issuance of building permits, the landscape plans shall be revised to show Dwarf
American vibernum or other approved shrub shall be planted along the west curb of the
compact parking stalls to screen the vehicle headlights from the adjacent homes.
10. Approval is contingent upon the applicant providing additional landscaping on the United
Properties site. If the applicant cannot provide the necessary screening in this location, they
must reapply for City approval of the alternative plan.
11. Signage for this site shall be in compliance with the Sign Ordinance and the PUD for Parkers
Lake Corporate Center.
12. All waste and waste containers shall be placed within the stricture. No outside storage of
trash or recycling containers is permitted. Prior to issuance of building permits, the plans shall
be revised to identify the location of the indoor trash enclosures.
13. All rooftop and ground mounted mechanical equipment shall be designed (including exterior
color) and located so to be aesthetically harmonious and compatible with the building.
Rooftop equipment over three (3) feet in height shall be screened with durable materials which
are aesthetically compatible with the stricture. In no case shall wooden fencing be used as a
rooftop equipment screen.
14. The wording "and for ponding purposes" shall be added to the plat along the west property
line.
15. The site plan shall be revised to identify the type of concrete curb and gutter and show the
curb and gutter with a double line symbol.

16. The 7 -ton paving section on the site plan and sheet of the constriction plans shall be revised
show 8 -inch class 5 crushed quarry rock, 2 -inch bituminous base and 1.5 -inch 2341
bituminous wear.
17. Move CB 3 five feet west to provide 10 feet of clearance from the shallow sanitary sewer
pipe.
18. The elevations of the 42 -inch storm sewer shall be verified from CBMH-4 south and CBMH-1
south. If necessary, the storm sewer shall be revised to eliminate any conflicts.
19. The sanitary sewer connection shall be an outside drop.
20. The plans shall be revised to correct a potential conflict between the 12 -inch HDPE at
CBMH-4 and the existing 24 -inch watermain. Adjust the storm sewer grades and sizes to
provide 18 -inch clearance. Confirm the water main elevation prior to constriction.
21. The scale on sheets 2 and 3 shall be revised to be 20 scale, not 50 scale.
22. The storm sewer from CBMH-6 to FES shall be increased to 15 -inches.
23. The existing sanitary sewer along the south property line is flowing east according to the
invert elevations, but the arrows show it flowing west. The plans shall be revised to show the
correct flow.
24. Note the radius of the driveway on the site plan.
25. Relocate the existing catch basin in the northeast corner of the site to the curb line of the
driveway.
26. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Removal of all hazardous trees from the property at the owner's expense.
c. Submittal of required utility and drainage easements as approved by the City Engineer
prior to filing the final plat.
d. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
strictures on sites adjacent to, or containing any open storm water drainage facility.
e. Submission of the required Financial Guarantee and Site Performance Agreement for
completion of site improvements within twelve months of the date of this Resolution.
f. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
g. The Fire Division shall approve location and number of fire hydrants.
h. Submittal of fire flow data with the final plat.

i. Compliance with the Ordinance regarding the location of fire hydrants, post indicator
valve, fire department connection, fire lanes, and fire lane signage.
j. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release
or reduction of any site improvement bonds per City Policy.
k. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the
dedication policy in effect at the time of building permit issuance.
