RESOLUTION NO. 98-683
AUTHORIZING THE VACATION OF
A DRAINAGE EASEMENT FOR PONDING
ELIM CARE INC.
DOCUMENT NO. 5168553
WI4EREAS, a petition was received to vacate part of a drainage easement for ponding created by
Document No. 5168553; and
WI4EREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WI4EREAS, a public hearing with respect to said vacation was scheduled for November 4, 1998 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WIffiREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of November 4, 1998; and
WIffiREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WIffiREAS, the Council did hold a public hearing on November 4, 1998 to inform any and all
interested parties relevant to the vacation of part of a drainage easement for ponding created by
Document No. 5168553; and
WI4EREAS, it was determined by the City Council that said easements were not needed for public
purposes;

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage easement for ponding created by
Document No. 5168553 be vacated:
The east 255 feet of the North Half of the Northeast Quarter of the Southeast Quarter of
Section 18, Township 118 North, Range 22 West of the 5th principal meridian lying
southwesterly of the southwesterly right-of-way line of State Highway No. 55,
EXCEPT the south 337.5 feet of the west 193.6 feet of said North Half of the Northeast
Quarter of the Southeast Quarter, and also EXCEPT the North 160 feet of the south
557.5 feet of the west 193.6 feet of said North Half of the Northeast Quarter of the
Southeast Quarter.
Adopted by the City Council on November 4, 1998.
