RESOLUTION NO. 98-682
AUTHORIZING THE VACATION OF
A DRAINAGE AND UTILITY EASEMENT CREATED BY
DOCUMENT NO. 5168555
ELIM CARE INC.
WHEREAS, a petition was received to vacate a drainage and utility easement created by Document
No. 5168555; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for November 4, 1998 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of November 4, 1998; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on November 4, 1998 to inform any and all
interested parties relevant to the vacation of drainage and utility easement created by Document No.
5168555; and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage and utility easement created by Document
No. 5168555 be vacated:
The East 10 feet of the West 70 feet; the North 6 feet; the Northeast 10 feet along
Highway 55; the East 6 feet; the South 6 feet; the East 6 feet of the West 729.6 of the
C Documents and Settuig, e,uigei Local Settuig, TempCCR 1998-682_59119,CCR 1998-682 doe

South 403.5 feet; the North 6 feet of the South 403.5 feet of the East 536 feet of the
West 729.6 feet; the East 6 feet of the West 199.6 feet of the North 166 feet of the
South 563.5 feet; and the North 6 feet of the South 563.5 feet of the East 139.6 feet of
the West 199.6 feet of the following described property:
That part of the South Quarter of the Southeast Quarter of the Northeast Quarter, as
determined by proportionate measure of the length of the East and West lines of said
Southeast Quarter of the Northeast Quarter, and that part of the North half of the
Northeast Quarter of the Southeast Quarter of Section 18, Township 118 North, Range
22 West of the 5t1' Principal Meridian lying Southwesterly of the Southwesterly right-of-
way line of State Highway No. 55, EXCEPT the South 397.5 feet of the West 723.6 feet
of said North half of the Northeast Quarter of the Southeast Quarter, and also EXCEPT
the North 160 feet of the South 557.5 feet of the West 193.6 feet of said North half of
the Northeast Quarter of the Southeast Quarter.
