HomeMy WebLinkAboutCity Council Resolution 1998-660CITY OF PLYMOUTH RESOLUTION 98-660 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR UNITED PROPERTIES FOR PROPERTY LOCATED EAST OF FERNBROOK LANE AND NORTH OF 34TH AVENUE NORTH (98157) WHEREAS, an application has been filed by United Properties which requests approval of a site plan and conditional use permit to allow constriction of a 70,420 square feet office building for property legally described as follows: Lot 2, Block 2, Plymouth Business Center 5"' Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of United Properties for a site plan and conditional use permit to allow a 70,420 square foot office for property located east of Fernbrook Lane North and north of 34"' Avenue, subject to the following conditions: 1. The site plan and conditional use permit allow the constriction of a 70,420 square foot office building in accordance with the plans received by the City on October 16, 1998, except as amended by this resolution. 2. All roof -top equipment shall be screened from view or painted to match the building. 3. The applicant shall install a four -foot high fence on top of the proposed retaining walls along Fernbrook Lane and the north property. Resolution 98-660 (98157) Page 2 4. Constriction traffic shall be prohibited from using the current access from Fernbrook Lane. Additionally, the applicant shall close the existing curb cut by replacing the curb. 5. The applicant shall remove the brush pile from the site if it is not located within the conservation easement. 6. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage prior to issuance of building permits. e. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. f. Compliance with regulations regarding handicapped parking spaces and access. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
