AUTHORIZING THE VACATION OF
EASEMENT RIGHTS FOR DRAINAGE AND UTILITY PURPOSES AND
PART OF A DRAINAGE AND UTILITY EASEMENT ADJACENT 1/20F VACATED
STREET AND LOT 1, BLOCK 2
WESTMINSTER ADDITION
WHEREAS, a petition was received to vacate easement rights for drainage and utility purposes and
part of a drainage and utility easement adjacent '/z of vacated street and Lot 1, Block 2, Westminster
Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for October 7, 1998 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of October 7, 1998; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on October 7, 1998 to inform any and all interested
parties relevant to the vacation of easement rights for drainage and utility purposes and part of a
drainage and utility easement adjacent '/z of vacated street and Lot 1, Block 2, Westminster Addition;
and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following easement rights for drainage and utility purposes

and part of a drainage and utility easement adjacent '/z of vacated street and Lot 1, Block 2,
Westminster Addition be vacated:
A. The northwesterly 10.00 feet of Lot 1, Block 2 Westminster Addition, according
to the recorded plat thereof, Hennepin County, Minnesota, except the
northeasterly 10 feet.
B. All of the reserved easement rights set forth in City Council Resolution No's 85-
710 and 91-493, as recorded in the office of the County Recorder for Hennepin
County as Document No's 1674943 and 2203351.
Adopted by the City Council on October 7, 1998.
