RESOLUTION NO. 98-612
ORDERING PUBLIC HEARING ON THE VACATION OF A DRAINAGE
EASEMENT FOR PONDING ELIM CARE, INC.
DOCUMENT NO. 5168553
WHEREAS, pursuant to M.S.A. 412.851 and the City Charter Section 12.06, Daniel J. Fair of
Elim Care, Inc. has petitioned the City Council for the vacation of the following drianage
easement for ponding created by Document No. 5168553:
The east 255 feet of the North Half of the Northeast Quarter of the Southeast Quarter of
Section 18, Township 118 North, Range 22 West of the 5th principal meridian lying
southwesterly of the southwesterly right-of-way line of State Highway No. 55, EXCEPT
the south 337.5 feet of the west 193.6 feet of said North Half of the Northeast Quarter of
the Southeast Quarter, and also EXCEPT the North 160 feet of the south 557.5 feet of the
west 193.6 feet of said North Half of the Northeast Quarter of the Southeast Quarter.
AND WHEREAS, the City Council has reviewed said request and found the same to be in order;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That it should, and hereby does, establish the date of
November 4, 1998 at 7:00 p.m. in the Council Chambers, Plymouth City Center, 3400 Plymouth
Boulevard, as the time and place for the public hearing of said petition and directs the
administrative staff to publish notice of said hearing as provided by law.
