RESOLUTION 98-597
APPROVING SITE PLAN AND CONDITIONAL USE PERMITS FOR OPUS
NORTHWEST, LLC FOR PROPERTY LOCATED NORTH OF BASS LAKE ROAD
AND EAST OF NATHAN LANE (98152)
WHEREAS, Opus Northwest, LLC has requested approval of a site plan to allow
constriction of a 190,400 -square foot office building on proposed Lot 4 of Bass Creek
Business Park 4"' Addition; and,
WHEREAS, Opus Northwest, LLC has requested approval of two conditional use permits
related to said office development to allow 1) increased building height, and 2) accessory
assembly use; and,
WHEREAS, the property is presently legally described as Outlot A, Bass Creek Business
Park 3" Addition, according to the recorded plat thereof, and situate in Hennepin County,
Minnesota; and
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval of the site plan and conditional use permits.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Opus Northwest, LLC for a site plan and conditional use permits for property
located north of Bass Lake Road and east of Nathan Lane, subject to the following
conditions:
1. A site plan is approved to allow constriction of a 190,400 -square foot office building
on proposed Lot 4 of Bass Creek Business Park 4"' Addition, in accordance with the
plans received by the City on September 11, 1998, except as amended by this
resolution.

2. A conditional use permit is approved to allow a building height of 70 feet, with the
finding that: a) the additional setback required for this height would be provided; b)
the increased height would not limit solar access to neighboring properties; and c) the
request meets the applicable conditional use permit standards.
3. A conditional use permit is approved to allow up to 38,000 square feet of accessory
assembly use, with the finding that: a) the proposed assembly use would be accessory
to the permitted office use; b) no outside storage is proposed for the site; c) the area
devoted to the assembly use would constitute 20 percent of the gross building area,
which is well under the 40 percent maximum specified by the Zoning Ordinance; and
d) the request meets the applicable conditional use permit standards.
4. Prior to issuance of building permits, payment of park dedication fees -in -lieu of
dedication in accordance with the Dedication Policy in effect at the time of building
permit issuance.
5. Any signage shall comply with the sign regulations of the Zoning Ordinance.
6. Prior to issuance of building permits, a detail for any proposed retaining walls shall be
provided.
7. Stop signs shall be installed at the drive exits to Nathan Lane and the driveway leading
to the Fingerhut site to the north.
8. Note the location of the B-612 curb and gutter with a double line symbol on the site
plan.
9. A looped hydrant system is required.
10. The developer shall not use the sidewalk on the east side of Nathan Lane for storage
during constriction. Any damage to the sidewalk shall be repaired at the developer's
expense.
11. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for
new strictures on sites adjacent to, or containing any open storm water drainage
facility.
C. Submission of the required Financial Guarantee and Site Performance Agreement
for completion of site improvements within twelve months of the date of this
Resolution.

D. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
E. Compliance with the Ordinance regarding the location of fire hydrants, lock boxes,
post -indicator valves, fire department connections, fire lanes, and fire lane signage.
F. Prior to issuance of building permits, submission and approval of fire flow
calculations.
G. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the
release or reduction of any site improvement bonds per City Policy.
H. No building permits shall be issued until the final plat is filed and recorded with
Hennepin County.
L Compliance with regulations regarding handicapped parking spaces and access.
J. This approval shall expire one year after the date of approval, unless the property
owner or applicant has started the project, or unless the landowner or applicant has
received prior approval from the City to extend the expiration date for up to one
additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
