APPROVING REAR YARD SETBACK VARIANCE FOR THOMAS AND JULIA
CARPENTER FOR PROPERTY LOCATED AT 4835 WELLINGTON LANE NORTH

WHEREAS, Thomas and Julia Carpenter have requested approval of a variance to constrict a
room addition on the rear of their home with a 17 -foot rear yard setback where 25 feet is
required, for property legally described as follows:
Lot 4, Block 2, Sky Line Hills, Unit No. 1, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Thomas
and Julia Carpenter for a rear yard setback variance for property located at 4835 Wellington Lane
North, subject to the following conditions:
1. This variance request to permit constriction of a room addition with a 17 -foot rear yard
setback is hereby approved in accordance with the application and plans received by the City
on August 24, 1998, and revisions received on September 3, 1998, except as amended by this
resolution.
2. This resolution is approved with the finding that the applicable variance standards are met.
Specifically:
a. The location of the existing home and steep slopes in the front and side yards create a
hardship for constriction of a room addition in those locations. The rear yard setback
variance is necessary to allow constriction of a reasonable room addition.

b. The variance is required due to the steep slopes in the front and side yards, which makes
an addition difficult in those locations. The hardship caused by the steep slopes is unique
to this property and not generally applicable to other property in this zoning district.
c. The variance request is not based exclusively upon a desire to increase the value of the
property, but is requested in order to accommodate a growing family in this home.
d. The hardship is based upon the location of the existing home and existing topography. It
is not a self-created hardship.
e. Granting the variance will not be detrimental to the public welfare or injurious to other
land in the neighborhood.
f. Constriction of the proposed addition will not impair an adequate supply of light and air
to adjacent property, or increase the danger of fire, or endanger the public safety,
substantially diminish or impair property values within the neighborhood.
g. The requested variance is the minimum action necessary to eliminate the hardship. The
applicant has stated that the additional width is necessary to make the room useable.
3. This approval shall expire one year after the date of approval, unless the applicant has
substantially started constriction of the project, or unless the applicant has received prior
approval from the City to extend the expiration date for up to one additional year, as
regulated under Section 2 103 0. 06 of the Zoning Ordinance.
