HomeMy WebLinkAboutCity Council Resolution 1998-584CITY OF PLYMOUTH RESOLUTION 98-584 DENYING REQUEST BY MARY WEINZIERL TO AMEND RESOLUTION 96-566 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR "GOLFVIEW WOODS" TO REMOVE REQUIREMENTS THAT ACCESS BE PROHIBITED FROM OLD ROCKFORD ROAD (96056-2) WHEREAS, the City Council approved a final plat and development contract for Golfview Woods under Resolution 96-566 on October 16, 1996; and WHEREAS, Mary Weinzierl has requested that conditions No. 5(I) and 5(N) of Resolution 96- 566 be removed so that driveway access may be provided off Old Rockford Road. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request to amend Resolution 96-566 to delete the conditions prohibiting access onto Old Rockford Road, based on the following findings: 1. The Comprehensive Plan recommends that access to Old Rockford Road be limited to major multiple unit developments. 2. The requested amendment is in conflict with the original conditions of approval for this development, and the applicant has not demonstrated that this condition is unnecessary or overly burdensome. The existing driveway can be moved east, onto the subject property, and still access off 45"' Avenue. FURTHER, in order to correct the existing problems due to the fact that the existing driveway is located off the subject property, the City Council of the City of Plymouth hereby resolves the following: Resolution 98-584 (96056-2) Page 2 1. The property owner shall move the existing driveway east so that it is located entirely within the boundaries of the subject property. 2. The property owner shall be responsible for all costs of the driveway relocation, including relocation of the fire hydrant if necessary to access the property.
