HomeMy WebLinkAboutCity Council Resolution 1998-583CITY OF PLYMOUTH RESOLUTION 98-583 APPROVING A VARIANCE FOR GARY BRAKKE FOR PROPERTY LOCATED AT 4350 JEWEL LANE NORTH (98133) WHEREAS, an application has been filed by Gary Brakke which requests approval of a variance to allow a four -foot high fence in the front yard; and WHEREAS, the Planning Commission has considered the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the variance for Gary Brakke for property located at 4350 Jewel Lane North, legally described as Lot 1, Block 1, Kimberly Woods, Hennepin County, Minnesota, subject to the following conditions and findings: I. This variance allows a four -foot high fence in the front yard, in accordance with the plans received by the City on July 21, 1998. 2. The applicant must obtain a fence permit for the fence. 3. The variance standards are met, as follows: 1) the physical surroundings, shape, and topographical conditions of the site create a hardship; 2) there are unique conditions related to the parcel due to the traffic volume and speed on Old Rockford Road; 3) the increased fence height would not increase in the value or income potential of the property and the applicant stated he would remove the fence prior to selling; 4) the hardship is caused by the ordinance; 5) the granting of the variance would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood; 6) The granting of the variance would not impair an adequate supply of light and air to adjacent property, increase the congestion of public streets, increase the danger of fire, or endanger the public safety; and 7) the fence height requested is the minimum height needed to alleviate the hardship.
