HomeMy WebLinkAboutCity Council Resolution 1998-578CITY OF PLYMOUTH RESOLUTION NO. 98-578 AUTHORIZING THE VACATION OF THE DRAINAGE AND UTILITY EASEMENT WITHIN BASS LAKE CORPORATE CENTER ADDITION, BASS CREEK BUSINESS PARK ADDITION, BASS CREEK BUSINESS PARK 2ND ADDITION AND BASS CREEK BUSINESS PARK 3RD ADDITION WIffiREAS, a petition was received to vacate drainage and utility easements within Bass Lake Corporate Center Addition, Bass Creek Business Park Addition, Bass Creek Business Park 2" a Addition and Bass Creek Business Park -1 Addition; and WI-IEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WI-IEREAS, a public hearing with respect to said vacation was scheduled for September 16, 1998 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WIffiREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of September 16, 1998; and WIffiREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WIffiREAS, the Council did hold a public hearing on September 16, 1998 to inform any and all interested parties relevant to the vacation of drainage and utility easements; and WI-IEREAS, it was determined by the City Council that said easements were not needed for public purposes; C Documents and Settuig, e,uigei Local Settuig, TempCCR 1998-5-8 59015 CCR 1998-5-8 doe Res. 98-578 Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following drainage and utility easement be vacated: All of the 20.00 foot utility easement as dedicated on the plats of BASS LAKE CORPORATE CENTER ADDITION, BASS CREEK BUSINESS PARK ADDITION, BASS CREEK BUSINESS PARK 2 N1 ADDITION and BASS CREEK BUSINESS PARK 3R1' ADDITION according to the recorded plats thereof, Hennepin County, Minnesota, the north line of said easement is more particularly described as commencing at the southwest corner of Outlot A, said BASS CREEK BUSINESS PARK -1 " ADDITION, thence North 0 degrees 32 minutes I I seconds East assumed bearing, along the west line of said Outlot A, a distance of 390.77 feet to a point of curvature in said west line of Outlot A; thence northwesterly a distance of 90.25 feet along said west line of Outlot A, being a tangential curve concave to the west having a radius of 568.94 feet and a central angle of 9 degrees 05 minutes 21 seconds to the point of beginning of said north line of the utility easement to be vacated; thence South 86 degrees 19 minutes 50 seconds East, not tangent to said curve, a distance of 880.48 feet. Adopted by the City Council on September 16, 1998.
