HomeMy WebLinkAboutCity Council Resolution 1998-575CITY OF PLYMOUTH RESOLUTION NO. 98-575 AUTHORIZING THE VACATION OF A DRAINAGE AND UTILITY EASEMENT WITHIN OUTLOT B — PRIME WEST BUSINESS PARK WHEREAS, a petition was received to vacate a drainage and utility easement within Outlot B, Prime West Business Park; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for September 16, 1998 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of September 16, 1998; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on September 16, 1998 to inform any and all interested parties relevant to the vacation of a drainage and utility easement within Outlot B, Prime West Business Park; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL, OF THE CITY OF PLYMOUTH, MINNESOTA: That the following drainage and utility easement within Outlot B, Prime West Business Park be vacated: All utility and drainage easements lying over, under and across Outlot B, PRINIE WEST BUSINESS PARK, according to the recorded plat thereof, Hennepin County, Minnesota as delineated and dedicated on said PRIME WEST BUSINESS PARK. Also C Documents and Settuig, e,uigei Local Settuig, TempCCR 1998-5-5 59012 CCR 1998-5-5 doe Res. 98-575 Page 2 A 20.00 foot permanent easement for utility and drainage purposes over, Linder and across said Outlot B. The center line of said easement is described as follows: Commencing at the northeast corner of said Outlot A; thence on an assumed bearing of South 89 degrees 11 minutes 28 seconds West along the north line of said Outlot A, 329.00 feet to the point of beginning of said center line; thence North 12 degrees 41 minutes East 40.00 feet; thence North 20 degrees 18 minutes West 71.00 feet; thence South 89 degrees 11 minutes West to the intersection of the above described "Point A" and said center line there terminating. Also A 20.00 foot permanent easement for utility and drainage purposes over, Linder and across part of Outlot B, said PRIME WEST BUSINESS PARK. The center line of said easement is described as follows: Commencing at the northeast corner of Outlot A, said PRIME WEST BUSINESS PARK; thence on an assumed bearing of South 89 degrees 11 minutes 28 seconds West, along a north line of said Outlot A, 444.12 feet to the point of beginning; thence North 00 degrees 48 minutes 32 seconds West 105.00 feet to a point hereinafter referred to as "Point A"; thence North 58 degrees 18 minutes West 440.00 feet; thence North 23 degrees 18 minutes West; 70.00 feet; thence North 01 degrees 42 minutes East 50.00 feet; thence North 79 degrees 42 minutes East 130.00 feet and said centerline there terminating. Adopted by the City Council on September 16, 1998.
