SG -98 -PF -93 BETWEEN THE METROPOLITAN COUNCIL AND THE CITY OF PLYMOUTH FOR THE CONSTRUCTION OF BUS SHOULDER LANES ALONG T.H. 169 BETWEEN 36TH AVENUE NORTH AND T.H. 55 WIffiREAS, the Metropolitan Council requested applications from transit agencies and transit authorities in the Metropolitan area for Transit Capital Project Funding; and WIJEREAS, the City of Plymouth operates a replacement transit service known as Plymouth Metrolink under Minnesota Statutes Section 473.388; and WIJEREAS, the City of Plymouth desires Regional Transit Capital Funding for Transit Capital Improvement Projects; and WIffiREAS, the Plymouth City Council by Resolution No. 97-587 expressed their support and authorized application to the Metropolitan Council for Transit Capital Project Funding for Plymouth Metrolink; and WIffiREAS, the application included a project for bus only shoulder lanes on both sides of T.H. 169 between 'Wh Avenue and T.H. 55 in Plymouth; and WIffiREAS, the City was subsequently notified that the bus only shoulder lane project ranked Number 1 in the Region out of 31 applications for Regional Transit Capital Funding; and WIffiREAS, MnDOT had scheduled a project including bus only shoulder lane constriction on T.H. 169 for a bid letting in the spring of 1998; and WIffiREAS, MnDOT has requested that the City of Plymouth/Plymouth Metrolink participate in the cost of that constriction in an amount not to exceed $125,000; and WIJEREAS, it was unclear at that time whether or not the Legislature would approve the Metropolitan Council's request for Capital Project Funding; and WIJEREAS, the City of Plymouth determined that an appropriate use of Transit Budget Carry Over Funds up to $125,000 would be for bus only shoulder lane constriction to permit constriction of this important project during the 1998 constriction season; and WIffiREAS, pursuant to Resolution No. 98-239 the Mayor and City Manager were authorized to execute the Cooperative Constriction Agreement between MnDOT and the City of Plymouth/Plymouth Metrolink Transit for the constriction of bus only shoulder lanes on T.H. 169 from T.H. 55 to 36"' Avenue North; and Res. 98-567 Page 2 WHEREAS, the Legislature subsequently approved the Metropolitan Council's request thereby ensuring that fiinding would be available for that project; and WHEREAS, Contract No. SG -98 -PF -93, an agreement between the Metropolitan Council and the City of Plymouth for Transit Capital Financial Assistance was prepared by the Metropolitan Council authorizing the total grant amount of $125,000 for the purpose of completing the bus shoulder lane only constriction project on T.H. 169; and WHEREAS, MnDOT has been working diligently on that constriction project since the spring of 1998, and the project is almost completed; and WHEREAS, MnDOT has submitted an invoice to the City of Plymouth/Plymouth Metrolink for $125,000 and the Metropolitan Council would not release fiinds until the agreement was finalized and executed. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the Mayor and City Manager are authorized to execute the grant agreement (Contract No. SG -98 -PF -93) between the Metropolitan Council and the City of Plymouth for Transit Capital Financial assistance for the constriction of bus only shoulder lanes on T.H. 169 from T.H. 55 to 36"' Avenue North.
