RESOLUTION 98-562
APPROVING A SITE PLAN AMENDMENT AND CONDITIONAL USE PERMITS FOR
BORDER STATES ELECTRIC SUPPLY LOCATED AT 2100 NIAGARA LANE NORTH

WHEREAS, Border States Electric Supply has requested a site plan amendment and conditional
use permits to allow accessory outside storage with an eight -foot high fence at 2100 Niagara Lane
North, legally described as follows:
The south 277.33 feet of Lot 13, Block 2, Circle Star Business Center Int Addition.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Border
States Electric Supply for a site plan amendment and conditional use permits to allow accessory
outside storage with an eight -foot high fence at 2100 Niagara Lane North, subject to the
following conditions:
1. The site plan amendment and conditional use permits allow accessory outside storage with an
eight -foot high fence, as shown on plans received by the City on July 21, 1998, except as
amended by this resolution.
2. The conditional use permit standards are met for accessory outside storage adjacent to
residential poroperty and for an eight -foot high screen fence, as follows:
a. The proposed use would comply with the Comprehensive Plan.

b. The proposed use and fence would promote and enhance the general public welfare and
would not be detrimental to or endanger the public health, safety, morals or comfort. The
use and fence would not create a safety hazard to, from or on a public street.
c. The proposed use and fence would not be injurious to the use and enjoyment of other
property in the immediate vicinity. The use and fence would not create a safety problem
for the adjoining properties or uses.
d. The proposed use and fence would not impede the normal and orderly development and
improvement of surrounding property for uses permitted in the I-1 zoning district.
e. The proposed use and fence would have no effect on public facilities or services.
f. The proposed use and fence would comply with the regulations of the I-1 zoning district.
g. The proposed use and fence would comply with the performance standards of the Zoning
Ordinance.
3. All chain link fencing shall be fitted with slats to screen the outside storage from the adjoining
properties and public streets.
4. The slats in the chain link fence shall be gray to match the building.
5. Barbed wire is not permitted.
6. A grading permit is required prior to commencing constriction.
7. Signage for this site shall be in compliance with the Sign Ordinance in effect at the time of
sign permit application.
8. Entrance gates to the outdoor storage area must be 20 feet wide for fire access requirements.
9. The outside storage of materials shall not exceed the eight -foot height of the fence.
10. The wooden gates for the trash enclosure shall utilize a minimum two inch nominal lumber.
11. Provide a fire lane section on plans.
12. A fire lane must maintained through the outside storage area, with fire access to the north wall
of the building.
13. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.

b. Removal of all hazardous trees from the property at the owner's expense.
c. Submission of the required Financial Guarantee and Site Performance Agreement for
completion of site improvements within twelve months of the date of this Resolution.
d. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
e. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire
lane signage.
f. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
