RESOLUTION 98-558
APPROVING A CONDITIONAL USE PERMIT FOR AN EIGHT -FOOT FENCE ON
PROPERTY LOCATED AT 12325 —29TH AVENUE NORTH (98148)
WHEREAS, Russell and Renee O'Dell have requested a conditional use permit to increase the
fence height at the property located at 12325 — 29t1' Avenue North on property legally described
as follows:
Lot 18, Block 3, Medicine Lake Estates, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Russell
and Renee O'Dell for a conditional use permit, subject to the following conditions:
1. The conditional use permit is for installation of an eight -foot fence, as shown on plans
received on August 15, 1998, except as amended by this resolution.
2. The conditional use permit is to allow an eight -foot high fence in side and rear yard with the
finding that all of the standards for fences exceeding six feet in height have been met.
Specifically:
a. The fence would be located in the rear and side yards, where six-foot fences are
permitted.
b. The fence would not exceed eight feet in height.
c. The fence would not be located in a required lakeshore setback area.
3. The conditional use permit is to allow an eight -foot high fence in side and rear yard with the
finding that all of the general conditional use permit standards have been met. Specifically:

a. The proposal would comply with the Comprehensive Plan.
b. The proposed fence would promote and enhance the general public welfare and would not
be detrimental to or endanger the public health, safety, morals or comfort.
c. The proposed fence would not be injurious to the use and enjoyment of other property in
the immediate vicinity for the purposes already permitted. The eight -foot high fence
would not create a safety problem for the adjoining properties or uses. The fence would
be constricted to screen the large recreational equipment on the neighboring property.
d. The proposed fence would not impede the normal and orderly development and
improvement of surrounding property for uses permitted in the RSF-1 zoning district.
e. The proposed fence would have no effect on public facilities or services.
f. The proposed fence would comply with the regulations of the RSF-1 zoning district.
g. The proposed fence would comply with the performance standards of the Zoning
Ordinance.
3. A fence permit is required prior to beginning constriction of the fence.
4. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
5. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof
shall be grounds for revocation.
