RESOLUTION 98-551
APPROVING SITE PLAN AND VARIANCE FOR OPUS NORTHWEST, LLC FOR
PROPERTY LOCATED NORTHWEST OF BASS LAKE ROAD AND HIGHWAY 169

WHEREAS, Opus Northwest, LLC has requested approval of a site plan to allow
constriction of a 123,066 -square foot office building on proposed Lot I of Bass Creek
Business Park 4"' Addition; and,
WHEREAS, Opus Northwest, LLC has requested approval of a variance related to said
office development to allow increased impervious surface coverage within the Shoreland
District for Bass Creek; and,
WHEREAS, the property is presently legally described as Outlot A, Bass Creek Business
Park 3" Addition, according to the recorded plat thereof, and situate in Hennepin County,
Minnesota; and
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval of the site plan and variance.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Opus Northwest, LLC for a site plan and variance for property located at the
northwest corner of Bass Lake Road and Highway 169, subject to the following
conditions:
1. A site plan is approved to allow constriction of a 123,066 -square foot office building
on Lot I of the proposed Bass Creek Business Park 4"' Addition, in accordance with
the plans received by the City on June 26, 1998 and July 1, 1998, except as amended
by this resolution.

2. A variance is approved to allow the impervious surface coverage with the shoreland
district for Bass Creek to be increased from 25 percent to 49 percent based upon a
finding that all the applicable variance standards are met. Specifically: 1) the portion
of Bass Creek adjacent to this site is located on the other (south) side of Bass Lake
Road, which is a four lane divided arterial roadway; 2) all storm water runoff from the
parking lot would flow north to the existing treatment and holding ponds before being
discharged into the storm sewer system, and therefore, would not have any negative
affects on the creek; 3) the factors involved in items 41 and 42 above result in a unique
condition not commonly shared in other cases involving a shoreland variance; 4) the
applicant has made substantial investment in the site based on the expectations of an
approved PUD plan which has since been rescinded; 5) the applicant has modified their
original plans to decrease the intensity of development on this site, therefore, the
purpose of the variance is not based solely upon a desire to increase income potential;
and 6) the granting of the variance would not be detrimental to the public welfare or
injurious to the neighborhood.
3. Prior to issuance of building permits, payment of park dedication fees -in -lieu of
dedication in accordance with the Dedication Policy in effect at the time of building
permit issuance.
4. Any signage shall comply with the sign regulations of the Zoning Ordinance.
5. Prior to issuance of building permits, a detail for any proposed retaining walls shall be
provided.
6. Stop signs shall be installed at the drive exits to 59"' Avenue.
7. The final plat shall include easements for the water quality pond to the 100 -year high
water elevation.
8. Prior to issuance of the grading permit, the applicant shall obtain the required NPDES
permit.
9. Note the location of the B-612 curb and gutter with a double line symbol on the site
plan.
10. The plans shall be revised to include a fire lane on the main north -south drive aisle
leading from the easternmost entrance to the site.
11. A looped hydrant system is required.
12. This resolution approves a variance to the Fire Code requirement for a fire lane within
50 feet of the south side of the building.
13. The developer shall not use the sidewalk on the east side of Nathan Lane for storage
during constriction. Any damage to the sidewalk shall be repaired at the developer's
expense.
14. Standard Conditions:
A. Compliance with the City Engineer's Memorandums.
B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for
new strictures on sites adjacent to, or containing any open storm water drainage
facility.
C. Submission of the required Financial Guarantee and Site Performance Agreement
for completion of site improvements within twelve months of the date of this
Resolution.
D. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
E. Compliance with the Ordinance regarding the location of fire hydrants, lock boxes,
post -indicator valves, fire department connections, fire lanes, and fire lane signage.
F. Prior to issuance of building permits, submission and approval of fire flow
calculations.
G. An 8 1/2 x II inch "As Built" Fire Protection Plan shall be submitted prior to the
release or reduction of any site improvement bonds per City Policy.
H. No building permits shall be issued until the final plat is filed and recorded with
Hennepin County.
L Compliance with regulations regarding handicapped parking spaces and access.
J. This approval shall expire one year after the date of approval, unless the property
owner or applicant has started the project, or unless the landowner or applicant has
received prior approval from the City to extend the expiration date for up to one
additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
