RESOLUTION 98-550
APPROVING FINAL PLAT FOR OPUS NORTHWEST, LLC FOR "BASS CREEK BUSINESS
PARK 4TH ADDITION" LOCATED NORTHWEST OF BASS LAKE ROAD AND HIGHWAY

WHEREAS, Opus Northwest, LLC has requested approval of a final plat to create four lots as
Bass Creek Business Park 4"' Addition, for the 59 -acre site located at the northwest corner of
Bass Lake Road and Highway 169; and
WHEREAS, the property is presently legally described as Outlot A, Bass Creek Business Park -1
Addition, according to the recorded plat thereof, and situate in Hennepin County, Minnesota; and
WHEREAS, the City staff has prepared a development contract covering the improvements
related to said plat.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the final plat for Bass
Creek Business Park 4"' Addition; and,
FURTHER, that the development contract for said plat be approved, and that the Mayor and City
Manager be authorized to execute the development contract on behalf of the City; and,
FURTHER, that the following conditions be met prior to recording of, and related to said plat:
1. The final plat shall be in compliance with the plans received by the City on August 18, 1998,
except as amended by this resolution.
2. A drainage easement for ponding purposes shall be placed over the water quality pond to the
100 -year high water elevation.

3. Prior to issuance of the grading permit, the applicant shall obtain the required NPDES permit.
4. The final plat shall be revised to indicate the standard drainage and utility easements as ten
feet wide adjoining rights-of-way, and six feet wide adjoining lot lines.
5. Park dedication fee will be payable prior to issuance of building permits, on a per lot basis.
6. Standard Conditions:
A. Compliance with the City Engineer's Memorandums.
B. Removal of all hazardous trees from the property at the owner's expense.
C. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for
new strictures on sites adjacent to, or containing any open storm water drainage
facility.
D. Location and number of fire hydrants shall be approved by the Fire Division.
E. Submittal and approval of fire flow data prior to issuance of building permits.
F. Submission of a Site Improvement Performance Agreement prior to
issuance of building permits.
G The Developer shall hold the City and its officers, employees, and agents harmless
from claims made by itself and third parties for damages sustained or costs
incurred resulting from plat approval and development. The Developer shall
indemnify the City and its officers, employees, and agents for all costs, damages, or
expenses which the City may pay or incur in consequence of such claims, including
attorneys' fees.
