RESOLUTION 98-527
DENYING A LAND USE GUIDE PLAN AMENDMENT, REZONING,
PRELIMINARY PLAT, AND PUD GENERAL PLAN FOR CENTRES GROUP
PLYMOUTH, LTD. FOR PROPERTY LOCATED ON THE EAST SIDE OF NATHAN
LANE AND THE NORTH SIDE OF 45TH AVENUE (98120)
WHEREAS, Centres Group Plymouth, Ltd. has requested approval of a land use guide
plan amendment, rezoning, preliminary plat and PUD general plan for property legally
described as follows:
Outlot C, Drakeland Business and Technical Center, Hennepin County, Minnesota
And
That part of the East 1035.59 feet, as measured at right angles to the East line of the
South half of the South half of the Southeast Quarter of Section 12, Township 118, Range
22, according to the Government Survey thereof, lying South of the North 125.00 feet
thereof. Except that part which lies Easterly of a line drawn parallel with and distant 30
feet Westerly of the following described line: Beginning at the Southwest corner of said
Section 12, thence North along the East line of said Section a distance of 610.18 feet;
thence West at an angle of 90 degrees a distance of 180.5 feet to the actual point of
beginning of the line to be described; thence deflect left an angle of 90 degrees and run
South parallel with the East line of said Section for a distance of 171.48 feet; thence
deflect right along a tangential curve having a radius of 3819.72 feet; (delta angle 3
degrees 49 minutes 50 seconds) a distance of 254.26 feet; thence tangent to said curve a
distance of 246.33 feet and there terminating.
Subject to a limitation of right of access from the above described premises to County
State Aid Highway No. 18 and to that part of 49t1' Avenue North lying within the East
525 feet of said Section 12, as acquired by the County of Hennepin in Deed Doc. No.
978821, File of Registrar of Titles.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the
request by Centres Group Plymouth, Ltd. for a land use guide plan amendment, rezoning,
preliminary plat and PUD general plan, based on the following findings:
1. The site meets all the location criteria for the existing guiding.
2. Because of the proximity of residential uses, development under the current guiding
could provide a better transition between residential and non-residential uses than
development under the requested guiding.

3. Commercial guiding and specifically, the proposed theater and restaurant would
result in substantially more evening and weekend traffic than would occur with
Commercial Office guiding. This means that commercial guiding could result in the
development of uses that produce greater amounts of traffic at the times when
residents would be most affected.
