RESOLUTION 98-523
APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR THE ROTTLUND
COMPANY, INC. FOR "THE VILLAGE AT BASSETT CREEK" LOCATED IN THE
NORTHWEST QUADRANT OF HIGHWAY 55 AND REVERE LANE (97080-F)
WHEREAS, The Rottlund Company, Inc. has requested approval of a final plat for The Village at
Bassett Creek; and
WHEREAS, the property is presently legally described as Outlots B, C, and D, Prime West
Business Park, Hennepin County, Minnesota; and
WHEREAS, the City staff has prepared a development contract covering the improvements
related to said plat.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by The
Rottlund Company, Inc. for a final plat for The Village at Bassett Creek; and,
FURTHER, that the development contract for said plat be approved, and that the Mayor and City
Manager be authorized to execute the development contract on behalf of the City; and,
FURTHER, that the following conditions be met prior to recording of, and related to said plat:
1. A final plat is approved for The Village at Bassett Creek, in accordance with the plat and
plans received by the City on August 17, 1998, except as amended by this resolution.
2. Appropriate legal documents regarding Homeowners Association documents, covenants and
restrictions, as approved by the City Attorney, shall be filed with the Final Plat. Maintenance
of the outlot located east of fiiture Revere Lane shall be addressed in the Homeowners
Association documents.

3. Prior to issuance of building permits, wetland buffer monuments shall be placed in accordance
with Section 21670.07 of the Zoning Ordinance. The monument design shall be approved by
the Community Development Department.
4. All roofed strictures including porches must stay out of the 15 -foot stricture setback area.
Patios and uncovered decks may encroach this setback by up to six feet, pursuant to Section
21670.09 of the Zoning Ordinance.
5. Development standards for the townhome site (Blocks 1 & 2) shall be as specified under the
RMF -4 zoning district, and development standards for the senior apartment site (Block 3)
shall be as specified under the O -R zoning district.
6. Prior to filing the final plat with Hennepin County, the applicant shall obtain a street easement
for the Phase I location where the preliminary plat indicates that 6th Avenue would encroach
on private property. If the developer is unable to obtain the necessary easement, 6th Avenue
must be relocated to avoid the private property.
7. Traffic noise from Highway 55 could exceed noise standards established by the Minnesota
Pollution Control Agency, the U.S. Department of Housing and Urban Development, and the
U.S. Department of Transportation. Mn/DOT policy regarding development adjacent to
existing highways prohibits the expenditure of highway fiends for noise mitigation measures.
The developer shall assess the noise situation and take the action necessary to minimize the
impact of any highway noise.
8. Lowest floor elevations must be identified and they must be at least two feet above the 100 -
year high water elevation.
9. Easements will be required from abutting landowners where grading encroaches on their
property.
10. The connection from Highway 55 to the frontage road west of the site shall be closed when
6th Avenue is connected to the frontage road during Phase 2 development.
11. Phase 2 development shall include a six-foot high wood screen fence along the west boundary
of the residential portion of the site.
12. Prior to filing the final plat, the site plan must be revised to identify concrete curb and gutter
with a double line symbol. Indicate that all parking areas would have B612 curb and gutter.
13. Compliance with the City design guidelines for constriction of the parking areas and fire lanes
must be indicated on the detail sheet.

14. All watermain and sanitary sewer with the private drives shall be noted as private to be
maintained by the homeowners association.
15. Revere Lane shall be shown on the plat to be dedicated as a public street.
16. Outlot A of Prime West Business Park shall be combined with proposed Block 3 or added as
a combined tax parcel with Lot 1, Block 1, Prime West Business Park 2"a Addition, located to
the south.
17. Assessments for Revere Lane shall be levied when this street is constricted.
18. Sidewalks must be provided along one side of all public streets within the development.
19. The Developer shall comply with the City's Tree Preservation Ordinance.
20. Standard Conditions:
a. Compliance with the City Engineer's Memorandums.
b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
strictures on sites adjacent to, or containing any open storm water drainage facility.
c. Submission of the required Financial Guarantee and Site Performance Agreement for
completion of site improvements within twelve months of the date of this Resolution.
d. Any subsequent phases or expansions are subject to required reviews and approvals
per Ordinance provisions.
e. Compliance with the Ordinance regarding the location of fire hydrants, post indicator
valve, fire department connection, fire department turn-arounds, fire lanes, and fire
lane signage.
f. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the
dedication policy in effect prior to filing Final Plat for the residential uses, and prior to
building permit issuance for the office use.
g. The Developer shall hold the City and its officers, employees, and agents harmless
from claims made by itself and third parties for damages sustained or costs incurred
resulting from plat approval and development. The Developer shall indemnify the City
and its officers, employees, and agents for all costs, damages or expenses which the
City may pay or incur in consequence of such claims, including attorneys' fees.
h. No building permits shall be issued until the final plat is filed and recorded with
Hennepin County.
i. No building permits shall be issued until a contract has been awarded for constriction
of municipal sewer and water.
j. Submittal of required utility and drainage easements as approved by the City Engineer
prior to filing the final plat.
k. Any signage shall comply with the sign regulations of the Zoning Ordinance.

m. Street names shall comply with the City Street Naming System. The plans shall refer
to the private drives as "private drives."
n. Private driveway access shall be limited to internal public roads and restricted from
10"' Avenue, Highway 55, and fiiture Revere Lane.
