HomeMy WebLinkAboutCity Council Resolution 1998-520CITY OF PLYMOUTH RESOLUTION 98-520 DENYING PRELIMINARY PLAT FOR HARSTAD HILLS, INC. FOR PROPERTY LOCATED NORTH OF HIGHWAY 55, WEST OF VICKSBURG LANE, AND SOUTH OF 36TH AVENUE (98018) WHEREAS, Harstad Hills, Inc. has requested approval of a preliminary plat for property legally described as follows: Outlot I, Sugar Hills Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommended approval with conditions attached; and WHEREAS, the applicant has objected to certain conditions needed to ensure compliance with the City's plans, ordinances and policies; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request by Harstad Hills, Inc. for a preliminary plat, based on the following findings: 1. The plan fails to meet the requirements of the Wetland Conservation Act that mitigated wetlands be designed with irregular edges. 2. The locations of buffer monuments have not been shown on the grading plan. 3. The applicant has not submitted a tree preservation plan in compliance with ordinance requirements. 4. The site plan for the property fails to show a sidewalk along 36"' Avenue and a sidewalk along 35"' Avenue. 5. The plat fails to designate the appropriate right of way needed for the ultimate design of Vicksburg Lane. 6. Right of way shown for the 35"' Avenue cul de sac does not meet the required 60 -foot radius. Resolution 98-520 (98018) Page 2 7. The lane widths for 35'h Avenue at Vicksburg Lane do not meet the City's requirements of 16 feet inbound, 6 feet median, and 14 feet, 12 feet and 14 feet outbound to have the access connection to Vicksburg Lane. 8. Driveway locations shown on the preliminary plat do not meet City requirements. 9. The plans do not properly show the culverts on Highway 55, including size and invert elevations. 10. The grading plan does not properly show the proposed grades for the adjacent property, West Glen Corporate Center. 11. The proposed paved width of 35"' Avenue does not meet the City standard of 40 feet to face of curb for and 50 feet to face of curb for the cul de sac. 12. The proposed street grades are not shown on the grading plan. 13. The final plat has not correctly identified the Highway 55 right of way as requested by MnDOT. 14. The Highway 55 access control opening has not been dedicated to MnDOT. 15. MnDOT has not approved a stormwater drainage permit for this development and water is drained to the MnDOT right of way.
