HomeMy WebLinkAboutCity Council Resolution 1998-519CITY OF PLYMOUTH RESOLUTION 98-519 DENYING LAND USE GUIDE PLAN AMENDMENT AND REZONING FOR HARSTAD HILLS, INC., FOR PROPERTY LOCATED NORTHWEST OF HIGHWAY 55 AND VICKSBURG LANE NORTH (98018) WHEREAS, Harstad Hills, Inc. has requested reclassification of the land use guiding from CO (Commercial Office) to C (Commercial) for the roughly 7.59 acres located in the southwest portion of this 25.8 -acre site located in the northwest quadrant of the intersection of Highway 55 and Vicksburg Lane North; and, WHEREAS, Harstad Hills, Inc. has also requested rezoning from O -R (Office Residential) to C-3 (Highway Commercial) for the roughly 7.59 acres located in the southwest portion of this 25.8 - acre site located in the northwest quadrant of the intersection of Highway 55 and Vicksburg Lane North; and, WHEREAS, the Planning Commission has reviewed said requests at a duly called Public Hearing. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request by Harstad Hills, Inc. for reclassification of the land use guiding from CO (Commercial Office) to C (Commercial) for the roughly 7.59 acres located in the southwest portion of this 25.8 -acre site located in the northwest quadrant of the intersection of Highway 55 and Vicksburg Lane North, based on the following findings: 1. The site meets the guidelines and location criteria for the current CO guiding. 2. The site does not meet the guidelines and location criteria for the proposed C guiding. The location of the subject property at the end of a cul de sac would not be suitable for the high traffic generation associated with the related highway -commercial uses. Resolution 98-519 (98018) Page 2 4. The proposed commercial uses would not be compatible with the surrounding land uses. It would not be possible to provide sufficient transition to the residential uses proposed north of 35"' Avenue. 5. No new information has been provided to support a change to the land use guide plan element of the Comprehensive Plan for this property. 6. Reguiding would have no significant impact on the supply of Commercial or Commercial Office land in the City. 7. Reguiding could negatively impact the transportation plan element of the comprehensive plan. FURTHER, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request by Harstad Hills, Inc. for rezoning from O -R (Office Residential) to C-3 (Highway Commercial) for the roughly 7.59 acres located in the southwest portion of this 25.8 -acre site located in the northwest quadrant of the intersection of Highway 55 and Vicksburg Lane North, based on the finding that the proposed rezoning is not consistent with the Comprehensive Plan and other City policies and plans.
