RESOLUTION NO. 98 - 513
AUTHORIZING THE VACATION OF
A CERTAIN DRAINAGE AND UTILITY EASEMENT WITHIN
OUTLOT F — SILVERTHORNE ADDITION
WHEREAS, a petition was received to vacate a certain drainage and utility easement within Outlot F,
Silvlerthorne Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for August 19, 1998 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of August 19, 1998; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on August 19, 1998 to inform any and all interested
parties relevant to the vacation of a certain drainage and utility easement within Outlot F, Silverthorne
Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following 20 foot wide drainage and utility easement recorded
as Document Numbers 5406653 and 5297316 be vacated:
The drainage and utility easement within Outlot F, Silverthorne Addition described as
follows: Commencing at the southwest corner of said Outlot F; thence on an assumed
bearing of North 89 degrees 49 minutes 53 seconds East along the southerly line of said
Outlot F, a distance of 195.67 feet to the point of beginning of the center line to be
described; thence North 00 degrees 10 minutes 07 seconds West, a distance of 168.00

feet; thence North 46 degrees 03 minutes 29 seconds East, a distance of 176.50 feet;
thence North 19 degrees 50 minutes 59 seconds East, a distance of 85.24 feet; thence
North 17 degrees 50 minutes 02 seconds West, a distance of 129.50 feet; thence North
37 degrees 33 minutes 51 seconds East, a distance of 105.22 feet; thence North 82
degrees 43 minutes 08 seconds East, a distance of 143.78 feet; thence North 36 degrees
55 minutes 09 seconds East, a distance of 171.99 feet; thence North 21 degrees 02
minutes 27 seconds East, a distance of 154.75 feet; thence North 56 degrees 38 minutes
02 seconds East, a distance of 109.77 feet; thence North 35 degrees 40 minutes 30
seconds East, a distance of 141.12 feet; thence North 13 degrees 29 minutes 44 seconds
East, a distance of 104.66 feet to the northerly line of said Outlot F and there
terminating.
The side lines of said 20.00 foot easement are to be prolonged or shortened to terminate
at said northerly line of said Outlot F.
A permanent easement for drainage and utility purposes over, under and across that part
of the above descried property described as a 20.00 foot wide strip of land, the
centerline of which is described as follows: Commencing at the southwest corner of
said Outlot F; thence on an assumed bearing of north 89 degrees, 49 minutes, 53
seconds east along the southerly line of said Outlot F, a distance of 195.67 feet to the
point of beginning of the centerline to be described; thence continuing as on the
description.
Adopted by the City Council on August 19, 1998.
