RESOLUTION 98-510
APPROVING LOT DIVISION/LOT CONSOLIDATION AND VARIANCE FOR
MARTIN LEEPER FOR PROPERTY LOCATED AT 5455 JUNEAU LANE NORTH
AND 5525 JUNEAU LANE NORTH (98123)
WHEREAS, an application has been filed by Martin Leeper (also signed by his parents,
William T. and Lillian Leeper) which requests approval of a lot division and lot
consolidation at 5455 Juneau Lane and 5525 Juneau Lane, as legally described on
Attachment One, attached hereto and hereby made a part hereof, and
WHEREAS, the proposed lot arrangement for which the lot division and lot consolidation
is sought is as legally described on Attachment Two, attached hereto and hereby made a
part hereof, and
WHEREAS, the applicant has also requested approval of a variance to reduce the size of a
non -conforming FRD zoned parcel from 12.2 acres to 5.2 acres; and
WHEREAS, the Planning Commission has considered the request at a duly called public
meeting and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
lot division, lot consolidation and variance for Martin Leeper, subject to the following
conditions:
1. This approval is for a lot division, lot consolidation and variance for 5455 Juneau Lane
and 5525 Juneau Lane, in accordance with the application and plans received by the
City on July 13, 1998.
2. The Variance allows the lot area of 5525 Juneau Lane to be reduced from 12.2 acres
to 5.2 acres with the findings that:
a) The circumstances relating to the proposal are unique because no new parcels
would be created. The variance would adjust the lot line between the two existing

properties, creating lot sizes of 5.2 acres and 12.1 acres instead of the current lot
sizes of 12.2 acres and 5.1 acres, respectively.
b) The variance is not based exclusively upon a desire to increase the value or income
potential of the land. The purpose of the variance is to facilitate estate planning
for the applicant's parents.
C) The granting of the variance would not be detrimental to the public welfare or
injurious to other land or improvements in the neighborhood.
d) The granting of the variance would not impair an adequate supply of light and air
to adjacent property, increase the congestion of public streets, increase the danger
of fire, endanger the public safety, or substantially diminish property values within
the neighborhood. No physical changes are proposed for either of the properties.
