RESOLUTION 98 - 490
APPROVING A SITE PLAN AMENDMENT FOR A PROPANE TANK AND AN
INTERIM USE PERMIT TO REDUCE THE NUMBER OF REQUIRED PARKING
STALLS LOCATED AT 3005 NIAGARA LANE N (98020)
WHEREAS, Thermogas Company has requested a site plan amendment for a 1,999
propane tank and an interim use permit to reduce the number of required parking stalls
from 60 stalls to 50 stalls on property legally described as follows:
Lot 4, Block 1, Playhouse Industrial Park 2"a Addition, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Thermogas Company for a site plan amendment and interim use permit, subject
to the following conditions:
1. The site plan amendment is for a 1,999 gallon propane tank, as shown on plans
received on February 6, 1998, except as amended by this resolution.
2. The interim use permit is to permit a reduction in the number of required parking stalls
from 60 to 50, according to the plans received by the City on February 6, 1998, except
as amended by this resolution.
3. The Interim Use Permit shall terminate if any of the following events occur:
a) The use of the building changes to a use that increases the need for parking
spaces.
b) City staff documents a parking problem associated with inadequate parking.
c) The floor area of the building is increased in size.

4. A building permit is required prior to beginning constriction of the propane system.
5. The tank shall be installed and protected to fire code requirements.
6. The height of the tank shall not exceed 20 feet, which is the maximum height allowed
for accessory strictures in the I-1 zoning district.
7. Standard Conditions:
a) Submission of the required Financial Guarantee and Site Performance
Agreement for completion of site improvements within twelve months of the
date of this Resolution.
b) Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
c) Compliance with the City Code regarding the location of fire hydrants, post
indicator valve, fire department connection, fire lanes, and fire lane signage
prior to issuance of building permits.
d) An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to
the release or reduction of any site improvement bonds per City Policy.
e) This approval shall expire one year after the date of approval, unless the
property owner or applicant has substantially started constriction of the
project, or unless the landowner or applicant has received prior approval from
the City to extend the expiration date for up to one additional year, as
regulated under Section 21045.09 of the Zoning Ordinance.
